Hi all,
My H1 is approved on November and I am not getting my H1 from my employer. I asked him but he refused. I think i need to have it right? or i should get a copy of my H1.

Can you please on this issue.

thank you
Kiran

You need to have your H1 for stamping, to prove you are on status, driver's license etc.
If the H1 approval has your name on it you have the right to keep it.
If the employer does not give you H1, tell them you are going to stop working - you will be surprised the impact that will have on their descion to keep your H1 approval to themselves. If the H1 approval does not have I-94 on it, you may be out of status.

Yes , you have the right to keep the approval notice with you .Some employers don't give it so that you don't change company . To change employer you don't need the original approval , a copy of it will do .Although for visa stamping you will need the original .There is a form called I-824 with which you can request a duplicate of the approval notice. I'm not sure if the employer has to request it or the employee can also .Check with USCIS .
