Non-Immigration H4 over stay.

After GC

past immigration history is of no consequences...
she will be allowed in with the stamp...
but for the timebeing file for 245i
 
I gone through similar kind of problem. They put couple of qreries and finally approved H4 from the previous H4 expiration date. Also, by using 245i, you can fight .
 
EAD

Hey Guys

What if the H4 expires but one has an EAD which is never used - will that be in status or out of status?
 
Does BCIS count H1 visa validity period

Is it ok to enter on AP if validity period for all H1/H4 are ok, but during 99 when I changed company my wife's h4 was applied 5 months after I joined new company.

But during that time my wife's h4 visa date were valid. So there is no gap in validity of all H4.

I don't know why company B had applied H4 visa 2 times, So Visa validity is continues but when I joined Company B my wife was having old H4, which was never cancled.
So Does she considered as in status? or out of status?

I think from H4 point of view she is fine.
What about I94 validity??
Before I94 expiry she should contain
minimum receipt of H4 (or) receipt of I485.
 
I-94 which is issued at US airport or I-94 bottom part of H1/H4

She went to India in august 2000 and stamp new H1 on passport in india, So Visa stamp date are valid. till today.

I-94 from H1 is valid till today.
