This is my situation, i hope someone can give me some advice. I overstayed my visa since age of 10 I came here legally back in 2001 and been here since I have never been in trouble until, In miami on March 23rd 2011 i was arrested at the age of 20 for possession of a controlled substance 1 Felony and possession of Mariguana under 10 grams Misdemeanor. I was placed in Drug Court because of no previous charges at all. I had volunteer to do a 1 year treatment program 2 drug tests a week including 2 12-step programs and 2 classes a week for a total 52 weeks. then once completed I went to miami and received a Nollo Prossed for both charges. they also said that i can expunge the nollo prossed so its never in my public record even do it was that disposition. I know that the government can still see everything even after expunged. do you think that i will have a problem getting my green card even after the charges are nolle prossed. I am married to a us citizen. and does it matter if my record is not expunged yet or should i expunge my record before i put my application because they can still see it whether its expunged or not. and i was reading about the FFOA (felony first offenders act) would that cover me? i live in florida and i got arrested on a 11th court circuit. but i believe the FFOA requires me to expunge in order to cover. i know that i should hire a lawyer to represent me for better odds but i want to have all the knowledge i can get. id appreciate the advice if any.
