NOID on I485

ok, more mystery..last week I was told all background checks are clear all we need is a 2nd FP since 1st one expired in May. So 2nd FP was requested for me. I was told to wait for 30 days. I saw LUDs on my approved 140 and 131 from 2005 no lud on newer 131.
I called today to follow up on FP notice, now the IO (was polite) says NOID :mad: was sent yesterday... At first she couldnt find my case, too many #s in my receipt number..
So I went to check the status online- there is an LUD on my 485 with todays date on it..I dont know what it could be. I already had one for legal status early on..puzzling!!

anyone had similar experience?

There are two possibilities as to why you received an NOID:

1) Your employer withdrew the I-140.
2) You were out of legal status long enough to make you ineligible for an I-485.

Just what was the RFE about, and how did you answer it?

My employer is sponsoring only one GC at this time and thats mine. They dont sponsor GC as a rule. So I have my own lawyer, who represents me.

I had an RFE on legal status back in 2006, my lawyer responded and USCIS acknowledged that they received what was asked - copies of all H1Bs since 2001. I was never out of status.

Thats why I dont get it..any other possibility?

Well, beyond that, are you criminally or medically inadmissible?

My gut tells me that the NOID is related to the RFE, since maintenance of legal status (or the lack thereof) is one of the most common reasons an I-485 gets denied. I think you're going to need to wait until the NOID is received, and see what USCIS claims are the grounds for their intent to deny.

Make sure your attorney knows it's coming, since you only have 30 days to respond and they need to be on the ball.

No criminal record. I doubt medical thing, though. I have been reading about TB test xray vs skin test. I dont remember sending any xray so I would like to rule that out as well..but will have to wait until I receive the NOID.
