NOID on AP

I recieved notice of intent to deny for my I-131 from Texas.

They asking me for proof of a filed I-140.

Why did they sent NOID instead of RFE?
Why do they need my I-140? Instructions on I-131 say that all I need is evidence that I filed the adjustment application, ie my I-485.
Besides, I never sent my I-140 and always was getting AP before.

And souldn't my I-140 be in my file anyway?
or may be they lost it while transfering my case from VSC to SRC?
or may be they screw something up with my I-140?

what seems to be the case?

Whenever sending documents to USCIS, you have to assume that they do not know anything about you and you have to show them all the proof.

my education certificates?
proof that I done my medicals?
my driver license?
my paystubs and w-2?
social security card?

there are lot of documents. Do I have to send all of them every time?

Besides, I-140 was filed by my employer, not me. I don't suppose to have a proof of filing of I-140. It's not my petition.

I agree it is silly. You would think that their own database showing ur I-140 status would be more reliable than a photocopy you send .... or any other document for that matter (I-94, IAP-66, DS-2019, I-765, I-485 receipt etc)

this is was what my lawyer told me....better safe than sorry and send all the documents ..
 
Issuing AP/EAD for 12 months is even sillier,these documents should valid till AOS is complete.

You can not possibly send ALL the documents.

thats why there are document requirements in instructions for each kind of petition.

Also copy of passport, copy of I-485, copy of I-140, copy of latest I-94, marriage certificate if you are spouse of main applicant

thats why there are document requirements in instructions for each kind of petition.

I am not saying all the documents such as diplomas/birth certificates etc etc...but documents related to your immigration status specifically since your last entry into US (e.g. I-94, Approval NOA from USCIS, perhaps entry exit stamps on your passport ).......and obviously other documents as required for a specific application.

I mean in the instructions I can read about copy of passport, copy of I-485, copy of latest I-94, photographs. Thats it. And it worked for me um... 5 times.

I am not saying all the documents such as diplomas/birth certificates etc etc...but documents related to your immigration status specifically since your last entry into US (e.g. I-94, Approval NOA from USCIS, perhaps entry exit stamps on your passport ).......and obviously other documents as required for a specific application.

Documents related to my immigration status:
Birth sertificate: confirms my birth country (in my passport it is USSR - there is no such country)

Diplomas and letters from my employer, from another companies, list of my publications and patents: confirm my EB1OR

Driver license: confirms my home address.

Social security card: confirms my SSN

paystubs and w-2: confirm that I still working for employer that sponsored my GC

boarding passes: confirm that I travel a lot and really need an AP

EAD: confirms that I can work legally in this country

phone bill: confirms my telephone number.

marriage certificate: confirms that I have a wife as my dependent

tax return: confirms that I am filing my taxes as a US full-time resident

Do I really have to send all documents that I send along with I-485 to prove my status in this country?
Why the heck did they write document requirements in I-131 instructions?

These are not requirements, read faq on this board, you are not first who get this kind of RFE.
