No W-2 for 2 years

If the H-1 was valid from April, 1998 thru Sept, 2000 and the person did not work would that make her out of status. Only worked for a month and then was on LOA but the attorney showed on 485 that the person worked from May, 1998 thru Sept, 2000. It was an error and now has been questioned by INS by asking for W2's.
Shall we file the amendment ?
 
Yes, out of status.
If you admit as mistake, you are providing ample evidence to BCIS that you committed fraud.
