That is a gap between the tax laws and the INS policies! But, if a non-citizen decides to go back to his country, he can get his social security contribution back subject to the "40 quarter rule". Basically, if you are in this country for 10 years and have paid Social Security and if you decide to go back you can take the money with you.
This is what I have heard and remember reading something about the 40 quarter rule somewhere. Anyone with more details could elaborate.

As I mentioned in my previous post, this is a GAP!! I don't know what happens in the case of a person who is here for 6 years, leaves the country for a year and then comes back on H-1B for another 6 years!! Whether the 40 quarter rule stipulates a contiguous 40 quarters or there could be a break in it is something I don't know.
But, in any case, if a person stays only for 6 years and goes back for good, then tough luck for him/her. I think (again not so sure) if India has a comparable Social Security program (not that US's is any good) and it has some sort of a treaty with US then a person could get the contribution transferred back to India.
I haven't researched this thoroughly but this is how much I know/heard of.

If asians were so smart why in the world they couldn't create the same system back home ? If the Asians were so smart they won't be logging here every half and hour to check the status of their GC ?
Asians are gold diggers , everyone wants to do easy stuff.....like getting bookie education etc etc instead of doing some extraordinary things like ordinary Americans do.

Asians are one of the hardest working ppl, the only problem is there are a few that don't understand why we are here, we contribute a lot to the success and prosperity of this nation.
