Hello Gurus,
I have question, is thare any problem in case of RFE interview
when I have month or two without paycheck? I work as a consultant, when I go for vacation I don't get paid but I'm still an employee. Do you think it would be a problem when I go for such long vacation? (doing maybe some part time job on my EAD)
thanks

For an employee, vacation will still show up in the paystub. However I dont see any problem.

Thanks, so as long as they keep you as an employee even without salary it's OK? So what about the salary amount requirements when I was applying for labour department approval.(reduction in recruitment) I don't remember but the minimum was something about 68.000 a year.
When I am on the banch I don't earn this money of course.
So the question is if this is supposed to be an offer only for the future work after getting green card, or should be actual salary in present time.

thanks again

Proof of employer's ability

INS can be interested in your employer's ability to pay you after GC approval and will think you being in bench is an indication that it is not going to happen.
So if you say that you were in bench then definitely it will raise a flag.

However this question is raised in most of the CP interviews, not while adjustment is in progress. Unless there is a employment related RFE you will not be required to submit your current paystub.

Yes, you're right maybe better is to not saying about banch but
long vacation or illness for instance. Th problem is that my company stopped to pay me what is supposed to pay, so in case in RFE I would be in trouble anyway. Thats why I'm looking for change, keeping the employee status. Whithin a month 180 days are gone and I'd like to try luck with my EAD somewhere else.
