No Objection Statement of reason

Hello everyone,

Please I'm in dire need of help. I am a J-1 doctoral student, married a USC and we have a 4 year
old son (USC). I want to apply for NOS but quite confused what to write in my Statement of Reason. Has anyone married a USC an got a waiver? I'll appreciate if you could please share your thoughts with me. Should my reason be based on my family or my research?

From what I have read online it is better to have an "objective" professional reason as to why you should be granted a waiver. Try to construct an argument saying something like: i) Your research will suffer if you leave the US; ii) Your continued stay in the US is in accordance with your initial J1-sponsor/program; iii) The US will gain by letting you stay.

I wouldn't even mention your family situation. Why? If waivers are given for being married to a US citizen, incentives are pretty perverse since it would be easy for people to get around the 2-year rule through marriage. I talked to a secretary at DOS a few months ago and she said indirectly that marrying a US citizen wasn't helpful in getting a waiver.

I second econgrad's advice. I wrote a statement of reason that directly argues that granting the waiver will help fulfill the goals of the program that I participated in originally, in my case the Fulbright program. I would strongly advise not to mention personal reasons.

In your case, there is two way according to me , which you can apply for your J1 Waiver

First and recommended in your case is

* Exceptional hardship to a United States citizen (or legal permanent resident) spouse or child of an exchange visitor:

second is NO OBjection

(if you dont want to disclose your family relationship while you in US)

I had to apply for NOS for my J1 waiver back in 2008 and just simply said that I am married to a USC. My waiver was approved.
