No I 94 with H1 approval notice!!!!

I have changed my visa from H4 to H1 and its approved from the 1st of october. But the approval notice that the attorney received doesn't have the I94 portion in it.
The attorney office said that this was an error from the govt officials n' they have sent a letter to them asking to send one with I 94. It has been a month since then and I'm still waiting.
Has anyone faced a problem like this, Please share!!
 
you may take the wrong copy. I remembered that INS issued 2 copies of I797. One is for the company without I94. the other is for the applicant. My company took the wrong copy when I got H1B.
 
I asked to my employer also regarding this but even he did not receive any copy with the I-94. The lawyer says that they didn't receive any I-94. Is it possible?
