My mom came to US in Aug'08 and got the I-94 till Feb-09. We recently went on a cruise to Mexico and the cruise company took her I-94 whiel departing US. While entering she got a new I-94 but it dint have any departure date stamped on it.When I asked the CBP agent about this he said its not needed and she can stay for 6 more months. Can she stay for 6 more months?

Thanks

Thanks for the quick reply. Her oriinal I-94 was taken when we left to Mexico. Is there a way to get the departure date stamped on I-94?

If her original I-94 was taken away and a new one issues, then this is a fresh entry. Yes she may stay for 6 months.

The IO at the border on her next entry will have record of both of her stays. If she stays for another 6 months in addition to her just past stay, she risks being adversely flagged. I suggest that you consider the taking of her I94 when you left Mexico as a mistake and that she remain only long enough to make the total of the 2 stays equal 6 months. This will certainly look good for her future entries.
