No EOS, AOS, COS

Went to USA Apr08 with B-1 visa. The Customs officer just allowed me to stay for two weeks and put "no EOS, AOS, COS" on the I-94 and passport. Cause was with pregnancy status then and started to bleed after the long interview. went to hospital afterwards and the doc provided certificate and advised me to find a lawyer to apply for extention to get more rest. The lawyer filed the extention but until my leaving USA on 13May08, no extention result came yet and the lawyer dropped the case after I left US. My visa will expire in Jan10 so as my passport. intend to go to the States again next year. when I apply for visa renewal, will the immigraion officer find the record (cause no I-94 and no record on the new passport) and reject me? In addition, if next year, would like to go to the States with my daughter who's a US citizen but only 5 year old, will we be rejected in the Customs?
 
My wife had a VERY similar thing happen to her. She came to CLT and the immigration officer searched her bags. In there the IO found baby scans. My wife is about 20 weeks, but quite petite, so she doesn't show easily. One would have to know she is pregnant to actually know that she is. Anyway as soon as they found out she was pregnant they just gave her a 2 week stamp (thankfully they didn't write no AOS/COS/EOS, though I'm not sure what difference it would have made). Either way, instead of doing anything that would have caused her issues in the future, we just decided it be best she left the US before her I-94 expired.

In your case, please, immigration aside..... who cares about paperwork, immigration status etc. Please, look after your health first. If you started to bleed I'm assuming that is not a good sign. If a Dr is saying you shouldn't travel, then don't do it. Don't risk your health and that of your baby. I'm no lawyer, but I would say that common sense will prevail. I hope. Good luck with it all.
 
Thank you very much for the sharing, BritishGuy. actually, I delivered the baby last year after going back home. so no pregnancy issue now. just no sure if it will have any impact to my future going to US again.
 
the lawyer told me that he had filed to withdraw the case before the result came yet (I filed on around 15th-apr-08 and left on 13-may-08).
 
If I go to apply for visa renewal, will they ban me from going to the States forever or 5/10 yrs? or I should wait longer time (say 2-5 yrs) and the record may expire?
 
Then I think that I'll try to apply for renewal anyways. Another thing is that my husband is a frequent traveler to the States as his company's HQ is in US. He's afraid my record would have any impact to him; ie if I get rejected by US office for the visa renewal, he may face challenge when he would like to renew his visa next time or having trouble when entering into the States. will it be possible that US gov may trace to him?
 
I seriously doubt he will be penalised for your overstay.

My mother (60 years old) was in the same situation. CBP put NO AOS/EOS/COS stamp (with 2 months visa expiration) on her passport at her last entry at Newark airport. I contacted few attorneys and response was 50/50. Some said it's better to file GC via Consular processing. Some said she is eligible to file GC from here.

We hired an attorney. We filed her GC within a month from her entry and received Receipt notices before her I-94 expiration. She was scheduled for I-485 initial interview. My mother and I (as a petitioner) went for I-485 interview today at Newark, NJ Office.

IO (african american male) asked for original birth certificates and asked several yes/no type questions from I-485. He also asked if she had my childhood photos which we had and showed to him. He also asked I-864 and i told that it was filed with original application. Key is some IO are lazy. So, it's better to take your filing copy with supporting documents. Interview lasted about 10-15 minutes.

He gave approval letter (saying recommended for approval of i-485/130) at the time of interview.

I just received "Card Production Email" from USCIS.

Those who are in similar situation, hire a competitive attorney. If you entered US legally and have no other criminal records and file i-130/485 before your i-94 expiration, you may be in LUCK like few of us in this thread
