No EB3 Approvals Lately!

What's going on with EB3 lately, no approvals! that means all the people who has PD less then May 01, 2001 approved. So are we just waiting for March to get some approvals for folks who has PD less then August 01, 2001????
 
My PD(EB3) is Feb 2001 and have been stuck in name check from past 2 years.

SR Request response(06/19/2007 ):It's in Name check
Senator's Office response(10/22/2007): It's in Name check
Contacted NSC through POJ on 12/19/2007:Still in name check
Sent a letter to Congress man on 11/29/2007:Still in Name check(01/08/2008)
Address Change Lud :01/08/2008
Sent a letter to First lady :Still in Name check(Got response on 02/13/2008)
One more enquiry through Senator's office(02/10/2008):Waiting for response

My PD is 5/97 - EB3 ROW.

USCIS consistently say 485s are processed by RD. The PD is only used to determine who is eligible to apply for 485 or to receive a visa #/green card. Furthermore, other posters in the forum are indicating they have heard that USCIS intends to process the cases stuck in name check for so long based on RD not PD.

While your PD is 9/02, your RD is 12/03. Therefore if your PD is current you should be one of the first to be processed.

It does suck. You are correct, but you have only been waiting for your 485 application to be processed for just over 1 year (your RD is 1/12/2007 if I recall correctly).

Do a search on USCIS.gov to see how the RD is used for applications. You'll find they always use the RD for processing applications and even try to provide processing dates by RD.

For I485 cases, the PD is used to identify who is eligible for a visa #. This then should provide USCIS with list of cases that can be processed to completion in FIFO order.

If PD was used to identify the order in which cases get looked at and processed then I'd be at the front of the queue along with folks like Akbari. However I've been waiting for 18 months (or so) and am behind others who filed in 2003, 2004 and 2005.

Ask your local congress person's immigration aide. They'll tell you the same "story".
