No decesion after 14 weeks of interview!!

arrived in US ON 27TH Nov 2007 on J1 visa valid 27th Nov 2007 through 27th Nov 2008 on newwark airport.


Married to US citizen july 8th 2008.


apply with USCIS Oct 2008.

got biomatrics done Nov 6 2008.


received EAD and advance parole in Dec 2008.


we appeared for interview on february 24 2009. officer asked basic questions and demanded J1 waiver. we told her its in process and we would get it soon. she told us to get it asap and send to USCIS. she granted us couple of months to get it.

in july 2009, i received a letter from DHS that my application has been denied because i couldnt get 2 years foreign residency waiver and also my EAD and advance parole has been terminated and put me in removal proceedings. they made this decision on july 9th 2009.


and also i received a notice that I-130 immigrant petition filed by my wife has been approved. (notice date july 09 2009)


september 13th 2009 i received a notice to appear in immigration court(spring st. atlanta) for master hearing on December 8th 2009.


september 23rd 2009 i got my foreign residency waiver approved.


Dec 8th 2009 i appeared for master hearing and lawyer represented me. judge told us to file to motion to terminate the removal proceding and to get finger prints done before january 1st 2010. we also got date for calender hearing in 2011 for back up.



march 2010 we filed i-485 to TSC and i havent received notice to get biomatrics done. According to lawyer they might have my finger prints in records.

ICE attorney agreed to terminate removal proceeding and they did in june but i got no notice of action. i also got my EAD in august 2010.

In sep 2010 my lawyer confirmed in infopass that atlanta field office has got my file to adjudicate after terminating removal proceeding by ICE.

Sep 20th 2010 i got letter to appear for an interview with my wife on Oct4th 2010.

we went to interview. it was simple begining with oath then i485 questions have you been this and that..? i said no except to removal proceeding and told her it has been terminated. she said yes and has a notice from judge. then asked my detail like name, when i came to us, DOB etc. she didnt ask any question to my wife and regarding our marriage. she flipped the file and and ask if we have more update documents. we gave her latest joint bills, insurance, lease and tax return.

then she said we get decesion in 4-6 weeks and there is more background to check.

its been more than 90 days no notice, no decesion. i went to info pass and IO told me that my file is sitting in her office and suggested me to send reminder to her. i sent to her and also called customer service.

Please if you have been in this situation or know anything. please write me. your suggestioins will help me.

We are sailing on the same boat. I got interviewed on Sept 10th, 2010.
No decision yet. IO indicated that she approved GC and that I should expect it in the mail in 2-3 wks.

There are a lot of folks on this forum dealing with this issue. Its seems like USCIS can delay processing anywhere from a few weeks to years.
It does not sould like yours will be delayed for a long period of time. I think you have already been through the ugly stuff and prevailed.

Schedule another info pass if you do not hear or receive anything in 30 days.
