this is sickening...I see no approvals at VSC ..none at all these days..for eb3 I have not seen one approval for a long long time.

I called my lawyer and she says she has seen approvals on the West Coast...but I dont see any on the East Coast!!!

if any of you have spoke to your lawyers or otherwise got any additional information please post as to what the heck is going on at VSC!!!

I am totally frustrated with this whole stupid procedure
 
One of my friends got his 485 approved in VSC recently.

PD 1/03
EB-2 (China)
RD 02/05
AP on 5/9 (become current on 5/1)
Both him and his wife were approved at the same time.
Card already received.

Same here. Looks like dates and procedures mean nothing at all at VSC - getting approved is just pure luck.

No VSC aprovals

Yes you are right,i don't see any VSC approvals.I have been waiting more than 40 days to receive my cards.This is getting really frustrated.

Called VSC

I just called the VSC...they said the same thing that my security check is pending with the FBI.

One of the officers had told me specifically that all the information they had to get from the FBI they got it...

I dont understand then again now how can it be still waiting for that information!!!

This is totally frustrating.
 
Hi All,

I spoke to my attorney regarding this. He told me to file a writ of Mandamus. My dates became current in Mar 2006 in EB3 category and got a mail from INS stating background check is incomplete.

He told me that INS has to adjudicate my case within 60-90 days. Getting stuck in background can take anywhere from 1 yr to 5 years.

Does anyone know is it worth filing? Will appreciate any help regarding this.
 
I think the EB3 cases have been put on a shelf (and not touched)

IMO the EB3 cases have been put off and are not being touched for some reason.

the only EB3 cases that I have seen being approved recently are ones where the NC was complete (and had received some RFE or something).

I dont think VSC is working on updating the securiry check results for EB3 cases for some reason.
 
I am also stuck in name check. My first name is short i.e less than 5 chars.
Is it the reason i am stuck in Name Check since Sep 2004?.

Guys please help me.
 
There is no Logic!!!

IMO there is no logic ..so I dont think we should try to find one.

My last name is complicated and no one--absolutely no one-- can think of having the same or similar last name..

so there does not seem to be a logic to whats happening at VSC..
 
Why are you all so impatient !!! ... There is always a logic

Chief Name Check co-ordinator Sr. John Smith has all the names on hundreds of long lists and he has sent Jack to check the names. Jack has taken all the files and he is checking the names day and night and its quite complecated to check the kind of names we all have. Visiting all our countries and checking the name with other related details is a heck of a job. Lotsa travelling involved and not to mention the paperwork, thats incredible.
 
My lastname is also impossible to get a hit.
