NIW without employment ??

Dear All:

I have lost my job due to layoff while my I-140
(EB1-OR) has been pending for over 8-9 months
at VSC. I understand that I-140 is gone now.

I am now changing to the H-4 status as my wife's
dependent.

It might take some time for me to get a new job.

Can I apply for NIW-based I-140 at this time when
I do not have a job offer ? Is it possible to apply ?
Has any one done that ?

Please, please help me.

I had self-petitioned NIW I140 approved without job offer. Took almost one year to have approved through TSC with one RFE. Have send P3 to NVC and am awaiting CP at Sydney, Australia. The main issue will be public charge criteria at interview ( I live in Australia and have never had a job in th USA). I have own resources and should be OK. You may wish to try your luck.

Some questions about EB1-OR (again)

Since I lost my industrial job (and hence a pending I-140 petition under EB1-OR), I am now applying for jobs, Here is my scenario:

1. University X is offering me a "Research Associate" position - a full time position - BUT it might have time limits (18 or 24 months of employment contract).

2. Is it possible to apply under EB1-OR
using this type of full-time but time-bound job ?

I will suggest to get a very competent lawyer and explore the possibility of EB1-EA. In my view, most of the cases of NIW can be easily interperated as EA cases. Input from a good lawyer will make all the difference.
