Hi Folks, Here is my situation. I applied for both EB2(NIW) and EB1(OR). First NIW got approved but the PD date was not current. After couple of months with RFE the EBI(OR) got approved. Since the PD for EB1 is always cuurent, I filed I485 based on EB1. Now the PD for NIW is current. Here is my question. Since there is more freedom (no 180 day rule, in case of lay off, firing, compnay shutting down) with NIW than EB1(OR), can I transfer my current I485 (EB1) to NIW? Or do i need to withdraw this and file a new I485? I do have EAD from EB1 (not using....still on H1B). Can I transfer this EAD to NIW. Please answer. I\'m in trouble...my company may shut down soon.. sanj12
