NIW-RFE waiting about two months

Still waiting, and I know that some other people that submitted RFE about one month later than I did already got approved. Does this mean that my case will get a denial? Anyone has similar experience lately either approved or denied please share some information.

Please try this no. if you have not tried already. This no. seems to be better than both online-status and 800 no.

My case was approved!

Hi everybody,

I just found out late last night that my case was approved on May 30th. It felt a little bit weird in a sense that I was in preparation for a denial, so I almost could not believe it when I saw it. It was a great relief though.

So keep you hopes alive.

by the way..this question is for all Niwers.
I just happened to see a question on one of the forums where a guy/gal who had NIw approved and waiting for AOS was asked once again to show if they are still working in the national interest area. This was 2001. Has this happened again. Is this usual 485 RFe or something different.
By the way...can NIW use AC21.

This is not unheard of, even today. They figure a lot can happen during (their) long processing times. You would be lucky to get this as an RFE. Sometimes they switch your case to a local office. I-140 approval is one thing, but you are probably looking at a good 2-3 years before you get that plastic card in your hand, more if you are transferred to a busy office like New York City. Trust me, I don't regret doing Consular Processing one bit.

I am kicking myself everyday for going thru AOS

My 140 was approved for CP but since we were working through some deadlines, I opted for AOS. Now I have moved although working towards exactly the same research goal with same duties. Lets see how it works. Can AC21 be used for NIW case:confused:
By the way..I really hate myself for not doing CP. :mad: Unnecessary frustation.
 
Change from AOS to CP if you have H1

You might still be able to do CP, even if you filed for AOS.

If you have an approved I-140, and have pending AOS, you can still apply for CP, but it will cause your AOS to be regarded as abandoned. As a result, you will lose the EAD and AP. If you are using them actively, then that's a bad thing.

However, if you concurrently have an H-1B, or other non-immigrant visa, you can use that for employment and travel, adn you are then free to abandon the AOS and opt for CP instead.

Maybe that will work for you. I guess it depends on how long the CP process is in wherever it is you need to go.

But i have moved from present location and using ead. morever its almost a year since filing AOS.(about the time Brian did CP :))
so for me AOS is better even though i have self petitioned 140. I guess this holds true for many aos applications filed last year.
By the way..can NIW use AC21 rules.
