NIW RFE - suggestions please

Hi, I have received RFE regarding my NIW I-140. Here is what the letter says -

"Additional evidence is requested to evaluate eligibility for a NIW pursuant to the tests established in Matter of New York State Department of Transportation, 22 I&N Dec. 214 (Please note: the evidence already submitted demonstrates that the proposed research employment has substantial intrinsic merit and would be national in scope).

Please submit copies of published articles by other researchers citing or otherwise recognizing the self petitioner’s research and/or contributions.

You must establish you have a past record of specific prior achievement that justifies projections of future benefits of national interest. You must establish, in some capacity, your ability to serve the national interest to a substantially greater extent than the majority of your colleagues. You must demonstrate to some degree your influence on your field of employment on the whole."


How should I handle this?

1. Not a lot of my work has been cited due to the small number of people working in the field.
2. The last line of paragraph 1 and the first line of paragraph 3 seem to be in conflict with each other.
3. Do I have a chance with the NYDOT case type flag?

This is a standard RFE, i.e. a lot of people have gotten exactly the same worded RFE. I'm sure you already submitted most of your qualifications the first time, but now you have to make them stand out.

Did you include any citations the first time around? Or since you say you don't have much, you didn't? If you didn't, do so now.

To make up for the small number of people in the field, you need letters letters letters. Try to get more expert letters attesting to 1- your influence, 2- their reliance on your work specifically, and 3- mention that the field is relatively new (but not in a way that dismisses its importance to the national interest).

Yes you do have a chance since this is a standard letter and most (but not all) people who respond to these ultimately get approved.
 
Agree - just submit more letters and point out to same things that mentioned before.... but dont actually point out that you said it - write it like it is new evidence
 
I also got same RFE for my I-140 @NSC. I am trying to get couple of more letters plus citations of my publications.

Got RFE (NIW@TSC)- now cleared

I am sorry for posting this in a hurry with no dates (with deadlines here)....

Just wanted to say that i got RFE too. APplied in June/july 2007 when there was a big opening or some thing. I got RFE which basicllay was a very long write up asking me to submit everything again - In a nuthell it just said NIW was supposed to show i am "great" in my field and must be accepted by people in the field with examples. I assumed either the person at USCIS wanted more time or wanted to give me more time. I was given 3 months. I had my wedding at that time and used the last few weeks to send few additional letters from professors in US and Japan. I made a very elaborate list of all publications where my work was cited. (So you basically make a list of all publications/journals where your work was refered). I did this some where in Feb 2008. Got the 140 approval last week of August.

Dont lose hope - take it positive that they just want to clarify something or they are buying more time. Good luck with your RFE. I was very tired and exhaused when i finished RFE (as i am right now). Getting those additional letters in the VERY last minute was big pain.

Congrats for your I-140 approval. I also applied in july 2007 @TSC but have'nt heard anything from them. Could you please tell us how many letters did you send the first time and how many did you attach the second time? What is your area of research?
