NIW-RFE requesting eta-9089

I got a NIW-RFE recently concerning my last July petition.

The officer asked me to submit a duplicated ETA-9089 Form. I am wondering if this is a mistake since I have attached ETA-750B with my petition.

I searched on the web and found USCIS ever agreed on accepting both 9089 and 750 form in Oct. 2005. Unfortunately I did not find the official link on their webpage.

Anyone has experience on this? I am not sure if my employer will sign 9089 form for me since I am DIYing my NIW.

Re:

For NIW you don't need to have your employer sign it, it should be signed by the petitioner/self. Could you please tell when in July did you submit your petition? Thanks.

that's what I thought.

My petition date is July 24th. E-file at TSC.

The RFE letter says: "Please submit two sets of completed and signed ETA From 9089." ('From' is a typo I guess)

Thanks. I think this rfe is a good sign, since all they ask is formal paperwork. Consult with an attorney how to fill it out and good luck!

Not really. :(

They also asked for "more evidence on my previous publications, such as citations" and "more opinions from other experts"

I am preparing more letters now.

It seems many june-july cases get an rfe, so its not unusual. Just get more letters and try to find more citations.
