NIW petition, please give me some suggestions, thanks

Hello everyone

I just came to this website and wish to get some suggestions and help.

I am planning to submit my NIW petition, my background see below, please give me some positive and negative suggestions.

Chinese citizen
MD from China, Ph.D in molecular and cellular biology from Sweden
4 research articles (including 1 cover story), 6 european/american meeting presentation/abstract, including 3 oral presentations
few citations (not more than 10), 4 reprint request
1 travel grant from european academic society
1 PCT patent pending (third nventor)
several media reports (they can be found in google)

But my weak point is supporting letters. (I only could find, 2-3 from Sweden, 2-3 from Harvard, for independent referees, I only could find 1-2 out of the US, one from china, one from europe/south america)

can anyone give me some suggestions how big chance my NIW petition can be approved or it is risky)

International letters are supposedly a plus for your NIW, not a drawback, since you can show that your work is of national (or even international) scope. Your publications and citations are way low but I heard in biology its much harder to get published than in engineering, so maybe you just want to explain that. On what visa are you right now? If you are on H1 you should probably just give a I-140 a try. Most lawyers will agree to re-file your stuff a few years down the road for free if it gets rejected. If you are from China you can't file for adjustment of status for a while anyway. EB1 is the only category current for China, and you likely don't qualify for EB1-EA. Just my 2c.

I think you should go for it. Your credentials sound reasonable for EB2-NIW. You may want either to try in addition to seek professional advice from a lawyer. It is free!
 
Thanks, I am in the US now, holding H1B. I am wondering normally how many supporting letters are needed ? in which how many independent referees there should be ?
 
I had 8 letters, none of them from government labs though. The latter is probably a very strong argument and helps a lot. I tried to get letters from NSF program managers but NSF seems to have an internal policy against it.

I got a letter from an NSF program director too. I guess this is because I have been on their review panels quite a few times. Try to check with a program manager you worked with if possible.

This is a question related to filling form I-140 NIW. In section 6. there is a question: Is this a permanent position? Yes or No.
What should I answer, I understand it doesn't matter in NIW but while looking at older post, I noticed there some issues in the past.
Any advise.

I answered Yes, because my appointment has a permanent nature.

ETA 760 part B. Can we use a post office box as an address? can use that anyway in form 140 too. Any idea?

It is ETA 750 B (not 760)- right ?. As per use of PO Box, I don't have any idea. I would suggest not to use PO Box until and unless some experienced forum members say it otherwise.

what issues? should i be worried if i respond NO?
 
IMO, it shouldnt matter if it is a permanent position or not. If it is a permanent position, employers are expected to apply on your behalf. But that is just my opinion and I know the servicecenters do not care much about my opinion.

i think it does make sense. but is it always true then that if your employer is applying for EB-2 on your behalf, you would go for labor certification rather than NIW? sorry for my ignorance:(
