I am completing my J1 waiver job in Missouri. After that I am looking to move to a new location in Missouri. Following is the language in the guidelines for obtaining NIW letter from MO state dept of health.


" A physician must work at the approved practice site for a minimum of 5 years. If the physician fails to comply with this section, the department shall report the physician to the INS and other agencies as necessary."

Also the MO dept of health requires a 5 year contract for giving NIW support letter, regardless of the fact whether someone has completed J 1 waiver for 3 years already.

5 year contract should not be a problem, however the question is, that if my GC does come through in 2 years and I leave the contract before the 5 years, can the MO state dept. of health really report me to the USCIS. USCIS guidelines obviously are that a physician needs 5 years aggregate work in underserved area to qualify for NIW. MO state would have me work for 8 years it seems. Any body with experience in that....
