NIW dilemma....

Hey all: I am new to this forum and am stunned by the extent of information available regarding immigration issues. I wish i was here earlier.

I am phd student from the US and will receive my degree end of may 2006. MY NIW based on my research is ready to go......however I have a MD degree as well and wasnt planning to do clinical training initially....but now I am offered a residency training position in an university to start as early as july 1, 2006.

I am not sure if I shoudl file my NIW now.....Even though I will be doing some research during my residency training but the primary description of the trraining is to take care of patients.

Should I still apply? I will be doing research during residency and also with my phd advisor since I am starting my residency in the same school.....any suggestiosn and advice would be appreciated...thanks in advance.....

are these two research similar to any extent.
what is important for USCIS is u serve national interst with good intrinsic merit in order to qualify for NIW.
As long as u r doing it it doesn't matter when you apply.

during residency i am going to take care of patients in addition to doing some research......but the primary responsibilty in the job description is patient care.....research is optional but I intend to do it....i can either do similar research or may be clinical research related tot he same area......

it is confusing.....while filing I140 I dont know if I should talk about my new employment.....since it wont be full time research unlike what I doing now ( whihc is the basis for NIW)....but I will be doing research in the same area in the future but not full time.....

what do you think eb1doc or others? Should I hold it or go ahead with it? thanks in advance.....

I-140 is for your future employment, but NIW does not need a job offer. It helps you case, however, to have one. You are free to do anything after you get I-485 approval (green card), as at this point, it does not matter which route you took to get the permanent resident status.
If you can proof that your proposed work has intrinsic merit, national in scope, and is of national interest, then you can apply for NIW. You also need to address all the three prongs of the NYSDOT case (reasons why you should be exempted from labor certification process). eb1doc and a few others have included detailed discussion of the NYSDOT case and provided some useful suggestions on this subject. Do a search on this forum. Good luck.
