NIW Change of Job filing new 140

Hi, I have an approved 140 and pending 485. I will finish my three year J1 waiver requirement in June. I am planning to change the job. If I get new state support letter can I file new 140-NIW now or do I have to wait until I actually move and start working at the new palce. Thank you.
 
you can file it any time, u have to file for I140 amendment , if your NIW is self petitioned u do not even need the new employer to sign it.
make sure u get the letter of support from DOH , also submit proof of completion of the three years with paystubs
 
Thank you. But, the problem is I will not complete three years until June. Can I file now explaining that I will finish three years of j1 waiver at the current job and then move. It is taking 4 months for 140 at NSC. I want to make sure the area does not lose it's MUA status before I go and file.
 
I am in the same boat as you ( NIW - I 140 apporved - self petitioned and I-485 pending ), the only difference is that I have already finished my 3 yrs of waiver and already changed the job with a new employer.

I already got a new support letter from the state department of health. I have changed the job in the same underserved area.

I am ready to file for I-140 amendment and have prepared all the documents my self (as my attorney was asking for 2-3 thousand dollars to file for an amendment)

Now -- I talked to one of the most prominent immigration lawyer (from Los Angles - who is considered authority in these matters...www.shu****man.com) and i was told that there is no need to file for an amendment if I didn't change the job out of state and if the first petition was self-petition.

Now I am confused as what to do? file I-140 amendment or no?

Has anyone else had similar situation? Was amendment filed? What was the process?
