NIW approved-Change of Job from University to Companies

Hi eb1doc and friends,

I got my I-140 under EB2-NIW approved on Feb. 28, 2006 and I filed both I-140 and 485 concurrently on Sep. 19, 2005. I have got my EAD and AP in Oct. 2005. At present I am working in University as a research assistant.

1. My question is if any company is willing to hire me can i switch over to company where I might work as Analytical chemist/R&D chemist/QC chemist. Definitely the type of chemistry work I do in University will not be the same in companies.

2. If so should I work with my EAD or they should sponsor my H-1B?

3. Will the change of job affect my pending I-485 petition?

Is there any anticipated problems if I change my job?

I would appreciate your valuable input.

YES & NO !!!1rules are not clear !!!! as discussed many times NIW don't need employer's loyality for 6 months after I-140 approval but some lawyers do insist on that

Normally people use EAD! However, as discussed many times there are many advantage and disadvantages associated with both

depends!! at the end of day when ur application is studied by officer ...if he thinks that its not convincing that you may have problem....generally if you work for 6 montsh after I-140 approval...............its convincing!!

Meaning if I am with the same employer for 6 months after I-140 is approved then changing job (to companies) won't be having problem in pending I-485 petition. My intention is not just leaving my boss and joining in companies

Well, maybe not quite.
I filed 140 in Feb 2006 thought Nebraska center, and it was approved in March. It is fast!! I couldn't file I485 due to the retro.

However, I am thinking of changing job now because of family relocation. So I am also much concerned about the "6-month" rule. I asked the international staff office in my university, and she says there should not be any problem.

I am also concerned about the different job title, which seems to be your concern too. My job title will be changed from "assitant researcher" to "senior programmer", although for both jobs I work in the same field - bioinformatics. I fill in the occupation as "biological researcher" when I filed 140. Maybe I should ask the new employer to change the job title. But I am afraid that it may require to post the position again. Could someone give me some advices on this issue?
