NIW approval without interview???

Hi everybody,

I'd like to know if anybody heard any NIW case got I-485 approval without interview?

I know most people who got approved no longer in this forum any more. But I'd like to hear those experts and frequent visitors' opinion.

I have been active on various forums (first J-1, later NIW/EB-1, after that on CP and then I-485 forums) for last four years I believe.

Not a single poster that I remember ever said his/her NIW-based I-485 got approved without local transfer/interview. Many EB-1 got approved without interviews though.

However, a couple of reliable posters here (like GC_impatient, Gchello, and may be AG and fikabir) mentioned in past that his/her friend (or someone they knew) got approved without interview. Almost all NIW-based I-485-waiters in past, who were kind enough to post their experiences, were transferred and interviewed.

When I asked about this to various attorneys (via e-mails or through their websites), almost all replied "that's not true, transfers are random, etc.." However, if I have to conclude on my own from what posters have said on various online forums in past, I would say odds are clearly and very heavily against the approvals without interviews for NIW-based I-485 applicants.

Thank you for GC_impatient and jigesh's reply. I really appreciate that. I believe what jigesh said is true.

My I-485 (NIW based) will be adjudicated in several months (RD 3/02) at Vermont. I believe the next step is local transfer and waiting for another 8-12 months for interview at Philly.

Is there anything I could do to expediate the case instead of praying?

I have a job offer which is contingent on permanent residency and requires me to start in September. Will miracle happen?

Usually they had RFE

but now transfer seems to be the case. Just beats the purpose behind the NIW category :(
My colleague (a post doc) had his NIW approved without RFE/interview. This was last year before the 4 month stoppage ?? but another colleague who had interview in Oct still hasnt got his approval.
so one doesnt know how many days will it be for transfer>-interview>-final approval etc.

For those whom this thread touches might find the following useful:

My question: I have observed that almost all I-485 based on approved national interest waiver (NIW) based I-140 get transferred to local centers for interviews. Is there such a memo to adjudicators? Do you remember any of your clients with NIW-based I-485 approved without interviews? Thank you.

Answer from lorenzo_lleras: My response will surprise you: I cannot actually remember ANY of our clients who have been asked to go to an interview. I must disclose that we do not do more than probably 10 NIWs per year, because we only take cases we feel are very strong but I really do not remember any who were called for an interview. On the other hand, given the subjectivity of the NIW, it would not surprise me in the least bit to have certain NIWs called for interviews.

My question: Thank you. Just a clarification. My question for interview was not during the I-140 stage but was for interviews during the I-485 stage with underlying approved NIW-based I-140. Thank you.

Thanks for your info. I'm also a NIWer. Though I'm on a one-way street to get 2nd FP , I couldn't afford to be shipped back to NYC.

Interstingly, our FP dates are same and RD is almost same (mine is 02/12), while ND is quite different (mine is 03/01). Being so close in dates, type of petition (NIW), and same location (NY); let's update each other if any progress is observed. Thank you.

It did not mention purposely about the waive of interview for NIW case. That may mean the interview for NIW is kind of routine. I am thinking maybe for people who filed NIW but also provided evidence of working for some employer, the chance of waive the interview may be high. This is just my guess.

Don't worry about tranfer, right now transfer is scheduled pretty quickly actually better than waiting at VSC forever, at least
you know which day is the judgement day..... :)

Have a friend, Feb RD, will get interview next month
