NIW and AAO

My appeal was sent to AAO in August 1999, and I haven’t heard anything yet. I remember there used to be some other people in this situation also. If you are still there can you tell me what you situation is now? Do you think congressman can be helpful to speed it up. In case it is denied, is there anyway to bring this case to the court? Thank you all in advance!

Hi folks,

Just thought, I would let you know of my situation... My initial NIW
petition came for review around the time of the infamous NYDOT case, and was promptly denied. About 40 days later my attorney filed an appeal (in the process we asked and were granted a time extension for filing; we reasoned that it was vacation time and we could not get a hold on some of the people whose letter we were to submit as additional evidence to the INS). Anyway, to make this story short, the AAU reversed the initial denial and granted my petition about 16 months later. So, I guess, this proves the point that appeals are doable, although my attorney said he was pleasently suprised of this outcome. That may mean that these AAU reversals are more exceptions than the rule.

NIW AAO Appeal Upheld

I recently heard from the AAO in Washington DC that my appeal was
upheld. I wrote the appeal myself without any lawyer and my NIW
petition was also self-petitioned. It took only 3 years for the whole
saga. The details:

NIW petition sent 06/13/98
RFE 10/10/98
Denied 06/120/99
Appealed to NIW 09/10/99
AAO approved petition 06/17/01

So it is certainly doable even if you do not have a lawyer. I wish all
who are waiting the best of luck, and I would also like to thank this
forum for giving me lots of insights on writing an appeal.

My NIW petition was denied first. We appealed in August 1999. We received a approval notice from AAO in April 16th. But still waiting for the I-140 approval notice from Nebraska INS office. Do you guys know how long does it take to get the I-140 approval notice? It\'s been almost 2 months now!

2 weeks after the AAO decision I got the I-140 from VSC. Curiously I never received any info directly from AAO. What I have gathered is form the voice message at VSC which said that they received a decision from AAO. I would certainly call NSC and ask what is happening. Good Luck
