I am happy about the decision but still confused on the some part. On one hand AILF indicated that the settlement won't take effect until after it is approved by the District Court Judge. On the other hand they indicated that INS will "adjust the status of enough asylees to reach the 18,000 minimum this fiscal year".

I appreciate your comments (specially those with legal background).

Also, AILF indicated that for additional information on the settlment, we can contact Legal Assistant Kerry Foley at AILF kfoley@ailf.org or 202-742-5607. Why don't we let Gilbert request more information on behalf this forum.

Well the USCIS is assuming the judge would also agree so they are getting to approve the 18,000...there are only 8 months left in this fiscal year. I have contacted Kerry Foley and she has responded that appeals court will have to send the case back to the judge who will set a date to issue the order...You are looking at probably August 05 for this to go in effect.

They are assuming approval from the judge in the next few months. This FY ends in 09/30/05, plenty of time for them to process 18000 cases.

That's a scary thought. It means that NSC will stop the processing of all other applications if they are to meet the 18K deadline by Sept.

I highly doubt they can ever be efficient.
