Dear All,

I had got the I-140 approval notice from USCIS.
The notice lists that my case was also forwarded
to NVC for consular processing.
Because I am outside of US, what is the next
step I should perform ?
Will NVC contact to me directly?
If yes, how long should I wait ?

Thanks for answering. Good luck to you too.

NVC will contact you (or your lawyer if you have named one on the I-140) but only when your PD is current (more precisely when NVC predicts that it will become current next month). It takes about 3-4 weeks for NVC to receive and enter your case to their system. You can check status by calling 1 603 334 0700.

Ones your PD is current NVC first will send you a DS-3032 form (if you have a lawyer they will send everything to him or her). Next step is the Immigrant Visa Fee bill. You have to attach a US money order or Cashier' check and send it back. (It is $400 effective January 1, 2008)
Upon cashing the check NVC will send you DS-230 with instructions.

Thanks for reply.

I just called NVC last night. Automatic answering machine told me that my case had been created at Dec. 10, 2007 and it will be sent in the few weeks.

Although I hired an attorney to handle my I-140, I-140 approval notice shows NVC will contact to me directly.

So, how long do I need to wait for it?
Because I am afraid of that mail may be lost.

Thank you so much.

Forms are generated on Mondays only. The automated system is usually updated by Wednesday. If you hear something like "Choice of Agent form has been generated and sent to the beneficiary on December xx" then you can expect the letter in a couple of weeks. (anything from 1 to 4 weeks, they sometimes do not actually mail the form right after it was generated)

First form you will receive is DS-3032 Choice of Agent. They will not send you a notice about generating your case even if the automated system says so.
If a lawyer is involved the first form will be the Immigrant Visa fee bill. DS-3032 will be skipped.

Question.

I had an attorney on record when the I-140 was approved. So the NVC sent the Fee Bill to the attorney. I paid the money and also requested NVC to remove the attorney from my case for CP.

The NVC sent me a letter confirming that the attorney has been removed from my case and that all further communication will be sent to either me or the petitioner (my employer). The same letter also mentions that due to shortage of Visa numbers, there might be significant delays in processing my case.

My question is - where does the "DS-3032 Choice of Agent" fit into this scenario? Should I be contacting NVC about this?

Thanks for Zolt's reply. My attorney really got the Visa Bill Fee last week.

I have a question....
Can I delay for 1~2months to send back the visa bill fee because
my wife will deliver our 1st baby soon? My attorney suggested me
to delay for a while until the baby has her name as well as passport.
Is it fine? Is there any expiration problem for my current stage?

Thanks for answering.
