Newly Wed. Need Dependant visa (Marriage certificate takes about 3 months)

Hi All,

Thanks for all sharing all the useful information on this forum. It is really helpful.

Here is my situation :-

a) Me and fiancee are both Canadian Citizens
b) She went to US on TN Visa earlier this year and now her H1 got approved.
c) We are getting married in early December and i want to go with her to US
d) I was working here in IT and out of job now in Canada.

My questions are :-

Q1) It takes about 3 months to get marriage certificate after you get married in Ontario (Marriage registration, certificate etc). We get only Solemnization of marriage certificate from priest a copy of our marriage license. Are these documents and marriage photos sufficient to get a dependent visa?

Q2) If my entry is denied as a dependent (let's say US immigration says without marriage certificate marriage is not legal) so come again when you have it, can i enter as a visitor or that can be denied too?

Q3) I have worked on TN in past in US, if i get a dependent H4, would I have any issues getting TN again?

Q4) She got her paper work for H1 and we both plan to fly out together after marriage, should that be ok?

1.Taking the docs you got on your wedding day are sufficient in the early days of marriage, so you will get H4 status.
2. See 1. If they deny H4 (they won't), you can enter on B2 only if you show proof of maintained foreign residence (which you do not need on H4).
3. You can get TN anytime, H4 is not an indication of immigrant intent, since it is also a non-immigrant status.
4. She is no doubt already in H1 status, so the only paperwork she neds his the I-94 attached to the botttom of her H1 approval, which she should already have stapled in her passport, so you will get H4 when you enter after wedding.
