Newbie Question: What happens to H1 after GC?

If AP and EAD have not been used and if H1 status is still valid when GC is received, how does one take care of terminating the H1? Does the H1 terminate automatically or do I need to inform someone? Im on H1 currently and applying for family based GC. So would like to know how to take care my H1 once i get the GC.

Your first priority should be to get the green card. From the pace of the process, it seems like your H1 will expire before you get the green card. However, you will get EAD within 90 days. You do not have to cancel your H1. Let it expire and switch over to your EAD once that happens. I never notified my employer that I have an EAD. When I quit, I never transferred my H1, I just showed my EAD to the new employer. Everything worked out fine

Thanks for your reply EricNeesGC... My H1 expires Jun 2006 and from what i read here, GC for immediate relatives does not take very long and being on the optimistic side, i expect the GC process to be completed before my H1 expires. Thats the reason i am in deliberation whether to apply for EAD and AP or not. I guess its just a peace of mind knowing that you have a safety net to fall back on if something goes wrong with the H1, correct?

I was curious when i asked the question in my previous post as i read about people working on their H1 and simultaneously having their EAD and AP. So that led me to think of what would happen to H1 once GC is received.

You got it right. Spending an extra $175 for EAD is better than taking a chance with not being able to work at all.
