Newbie- need help with I-864 form..!

Here are my questions:
My wife is sponsoring her mother in Philippines. Her mother has three under age kids, and she is planning to bring them along with her. Part 3 of I-864 form is very confusing.

1. Is it better to complete the form by typing using PDF form of I-864 from online download?

2. We'll provide 3 years of taxes and the most current W2. We included the assets in number 26 of part 7 in the form. Do we have to include bank statement, 401k and real-estate holdings?

3. Are we supposed to select "I am sponsoring the principal immigrant named in part 2 above." in number 8, and select "YES"? My wife is not sponsoring her siblings but her mom planned to sponsor them and bring them along to U.S. Should my wife select "I am sponsoring the following family members immigrating at the same time," in number 9 of part 3? And enter her siblings’ information in A, B and C lines.

We'll need the information above to complete I-864 form. If anyone can provide help, we'll appreciate your help very much. Thank you very much.
 
1. you can do either or. i just wrote everything in.

2. you only have to show 1 year of taxes (your most recent) now. you can still show 3 years but it's not necessary. if you are talking about submitting statements to show where the money is coming from along with the application then yes, if you added it on number 26 you have to submit the statements.

3. i don't know too much about the answer to this question, but in # 8 you will have to say yes, as your wife's mother is the principle immigrant. she will also have to include her siblings if they are coming along. the whole sibling thing is what i don't know much about. but what i do know is that whoever is coming along with your wife's mom has to be included in the affidavit, even if your wife's mom has enough money to support the kids, the citizen is financially responsible for them. if they are all included, your income requirement will be 125% of the poverty line for a family of 6 (you, your wife and the 4 immigrants), if you have kids then they have to be taken into account too.

1. I decided to type using the PDF. It is a lot easier for me to edit the document before print it, and it look a lot better too.

2. I guess that I'll submit only the 2005 tax return and 2005 W-2. I am copying the entire asset statements. For the house asset, what type of statement do they need to show its equity? Another question, we're joints the banks and income tax. Do I still need to fill out the I-864A and split the entire banks and house assets in half?

3. There will be four of them coming from the Philippines and four of us here in the family. It turns out to be eight of us. What is the easiest way to figure the poverty line? Let say, our household yearly income is $100,000.

i don't know if you can copy the assets statement, i used assets and i sent in the original statements. if you are including real estate then it has to be a house other than the one you are living in (you cannot use your own house) and i believe it has to be appraised. i do not know about the joint thing.

for the poverty line, go to the sheet that has the numbers for 2006/2007 (the latest one they have) and see the amount for a family of 8, then see the 125% of that number (in the column next to it), that is the minimum you have to show you have.

It shows $42K for a family of 8. Is this equivalent to $42K of asset? There is $20K in the bank, over $100K for house equity and over $100K in 401K. The household income is close to $100K a year. Is this enough to cover the poverty line? I didn't copy the asset statements. I printed the current bank statements and 401K statement. These statements are available online through our banks and 401K account. I had the house appraised 5 months ago. I have over $100K of equity. It is the house we live in. Does anyone know if it is okay to send the appraised document to them?

you cannot use the equity of the house you live in, so you cannot add that 100K. if you have another house or other real estate investments you can use that, but not the house you live in right now. the whole of the affidavit is that the cash has to be readily available within one year, since most likely you are not going to sell the house within one year they do not allow you to use it. i do not know if the 401K can be used, i think it can, but remember you have to prove that the asset is available within one year. you can use the amount in your back account, what about your salaries, do either of you make more than 42K a year? or do both, together, make more than 42K? if you do, then you do not even have to show assets.

Are you saying $42K is referred to annual income? I thought we have to have the $42K in assets. If that is the case, we're fine then. Our household annual income is almost $100K.

So all we need is to submit the 2005 income tax statement and W-2? If that is all they need, it is a lot easier than I thought. Thank you very much for your help.
