Newbie - Consular processing question

Hi All:

I am a managerial executive, here on a L1-A since March 2003. Recently, I spoke to my company to apply for my green card, and the process is about initiated. Since I am a absolute newbie with no experience what so ever, I want some advice on how to go about the process so I can get the fastest results, and avoid mistakes.

I have been told that in a L1-A, I do not need to go for labor certification, so that step is skipped. What remain is I-140, and I-485. I believe I-485 is filed by my employer, and I-140 is filed by the individual - or maybe the reverse, not sure.

I had a question on taking the consular processing route, instead of applying for I-140. I am told that consular processing is a lot more faster, and the only little trouble is that I will need to go back to the embassy in my country (India in my case) to appear for the interviw. That is not a hassle for me, I should be able to do that.

What is the experience of others on this? Should I take the consular processing route, or is applying I-140 here better? Please advise.

Consular processing is not necessarily the fastest route any more. With the visa dates retrogressing in Jan'05, maybe it may become a faster route than going the 140/485 way.

One of the drawbacks with consular processing that if the consulate rejects your case, they cancel all your US visas until the issue is resolved, so you may be stuck there. Also, you don't get EADs for work authorizations. If your company and job is strong and stable, it might be a viable way, you may want to post in the Consular Processing thread elsewhere in this forum.

Are you sure you can skip Labor certification on L1? Only nurses and EB1 guys can skip labor certification.

You seem to be confused about who files 140/485, 140 is filed by the company amd 485 by you. Usually the lawyers take care of both, but you get the idea.
 
Read up a bit...

I suggest you go to www.immihelp.com and click on the section of GCs and there you will get clear information on the steps to GC. It will be helpful to you in the process to know how it all works.
