reduced staff !, I did not know they have them from the beginning :)

I think this is a preparation for the NPC phase.

I asked my lawyer and they told me that Regional NY DOL is processing cases from May 2004 and SESA is still processing from beginning of Oct (as per their phone conversation with those guys). Also, as they have reduced the ppl in state processing now, so it might be more slow.

At least, it means they are processing Oct not September as per the phone update.

Hi NY folks
its long time i came and posted some info
i just want to give some information

my case has been filed from NY city on sept 1st week of 2001, i was layoffed from my company in august 2004 after 4 years of service there, i am in 7th year at that time.

i dont know where i have to go becoz my company is big financial firm ,they already informed INS about my case that i got layoffed,
they just give me some time so that i can look for another place

after wasting valuable time in ny, i got employer from NJ, he applied my labor from Maine, my laobor got Approved in 5 months without any queries

after i got layoffed from previous company, new employer applied 140/485/ead/ap for me in sept 2004
i got my EAD/AP approved in just 9 days, THANK GOD FOR THAT
and i got I 140 appoved email yesterday
i am so happy now ,THANKs to GOD
my wife got rfe's on EAD/AP but yesterday she got EAD approval email
hope she'll get AP approval also

Congratulations zamq!

I am sincerely happy for you and hope that you see your layoff (as hard as it probably was) as a blessing - you are now leaps and bounds ahead of where you would have been (at least from a GC perspective) if you had stayed with your original employer.

I am observing this forum from the day it started. My RIR was filed with NY SESA on Oct 26, 2001. I would like to thank everyone particiapting in this forum. i think this is the only place where we can get accurate, current and reliable information.

Yesterday I requested my employer to call NYS (212-621-9375). The whole conversation took place in my presence. He asked employer name and when we provided he informed, from our comapany they received two case with their name and priority date. As per him they did not reach to my priority date as they are processing first week of Oct 2001. We asked when we can expect our case, he said they have no idea. He was saying their staff has been slashed from 45 to present staff of 14. He said had their been 45, they could have finished Oct 2001. He said they are waiting for this election to be over and then they will further decide how to proceed with regard to NCP. So it appears presently they are not doing anything. As per him for RIR everything is ready from thier side, but for non RIR they may have to do something more before it is transferred to NCP.

I was hopeful that in 2004 I may have some progress, but now it looks it is one more frustating wait year.

According to the memo, after January 1st the SESAs will only stamp applications they receive, and then forward them to NPCs for processing.
And the SESAs definitely won't have a huge backlog (or any backlog), because all of this backlog is now being sent to the Backlog Elimination Center.

So the bottom line is that there will be absolutely no backlog for whoever files on 1/1. Actually, anyone who needs to file for labor now should better wait until 1/1 and then get processed very quickly. For us it's anyway too late...

I was also surprised and frustrated yesterday, considering on Sept 17, 04 as per website they were processing Oct 2001 and till yesterday (Oct 26, 2004) they are processing only first week of Oct 2001. Judging their progress, I doubt they can process my case in SESA.
 
This basically means NY SWA has not started transferring cases to BECs. According to the transition doc, the transfer should be happening now....Looks like they are slipping on the dates.

They may not advance beyond that anytime soon. They must be too busy packing the thousands of files and sending them to the Backlog Elimination Center.

And there's more chance of them losing cases in the transition ! ooopppsss a cabinet load of cases fell off the truck !

- NPC processing filings post-jan/05

- BEC trying to reduce the huge backlog

that would be the ultimate backstabbing to all of us waiting for years ... well, I would definitely file again, even if I had to pay for another process ...

can you please post the URL or the entire memo here ?! I'd appreciate that ...

guys, any idea how to request a proof of labor pending for more than a year to apply for the 7th year extension, should we go by NY SESA or BEC ?

A friend got approval filed in sep2002

All,
I have been following this forum for a long time, wanted to share this news with all, it is really surprising that a friends LC filed as RIR in NY got approved, the date was sep2002 no its not a typoit is 2002. so what does this mean for all of us. is this just one lucky case or does this imply something.

I am totally confused, wanted to get the views from forum members, i have no other details, as the friend would not give, only thing i can think of is it was a non profit organization, does that make a difference.
