Hi All

Great forum - lots of information

I have just started looking into the EB1-EA and the NIW visas. Can you please help with some questions.

I understand that if I apply for EB1-EA that I can also apply for permanent status for my wife at the same time - is this also the case with the NIW visa?

I am thinking of doing a DIY application - if you are turned down in these categories can you reapply using an attorney? Does it affect your chances having been rejected once. Does USCIS prevent you from reapplying.

I can't think of anything else right now but I am sure that I will need lots of advice if I decide to go ahead with the application.

I have letters of recommendation from companies that I have liased with during the course of my work. These letters praise my work etc and have been sent to me to show their appreciation of my services. Will these letters be suitable for submission or do I need to follow a set format that contains various 'buzz' words? Also should the letters be directly addressed to the Nebraska Service centre?

I would really appreciate it if someone has a template/guideline of what a letter of reference should contain - if you could let me have details.

while templates are available both commerially as well as by searching this forum, it would be best if each letter was uniquely written while saying similar things.

buzz words are the key. the letters must say that you are the best of the best (EB1) or exceptional and do work that greatly benefits the well being of the nation (NIW).

it must appear that the recommender really knows you and has indepth knowledge of yuour work. they should highlight some aspects of your research to show that you qualify as extraordinary (eg but not limited to a paper in nature or science) ; satisfy national interest (eg but not limited to being a key personnel in a grant that seeks to develop new alternative fuels).

the letters must say why a US national will fail to do your work to the fullest satisfaction and why LC must be bypassed (NIW).

letters for EB1-OR
needs emphasis on
outstanding skill set
outstanding acheivements (which makes you 1-2%)
outstanding awards/memeberships
where as NIW needs emphasis on
national interest
intrinsic merit
why you want to avoid labor
plus a bit of Eb1 -or set

independent letters are always better than related
yes you must write to USCIS

If I apply for EB1-OR with NIW do I need a job offer or can I self apply?

Also

Am I correct in thinking that you can use NIW to come over to the US to study for a PHD?

Does anyone have any info on the steps for this?

i would suggest you to read little bit more over net about NIW & Eb1-OR
