EADs are no use if i-140 is pending

The only advantage in this case is, EAD protects the legal status if H1 is expired.
I don't think, we can use AC21 portability with EAD's when
I-140 is still pending.

I140/485 Concurrent filings

Per VSC, I was told that if you had filed initially I140 and then took advantage of new concurrent filing and filed I-485, I765 and I131 then you I140 would be pulled out and will be processed as per the schedule processing of I-485.

I do not know if this is true! This raises new questions on 180 days portability and what happens if you change your job fter 180 days of filing of I485.

We have to just wait for the regulations to come outregarding concurrent filings.:(
 
This means file of I-485 and I-140 are merged and processed together. What is meant 'processed as per the schedule processing of I-485' ? is that means I-140 is processed along with I-485?

Please anybody explain.

I trust this is not true. I have seen several posts on this forum wherein people have got thier I140 approved after they filed 485 with I140 receipt taking advantage of concurrent filing when I140 was already filed. What this means is they do not merge the 2 files - I140/I485 and put your I140 on the same time track as I485.

Mike_Metal: Whats the source of your information. Did you speak to an INS officer who gave this info?
 
Some one told if they have to deny I 140, they wouldnot issue EAD. Once you got EAD, that means you are eligible for that particular job.

Then what is a point of denying I 140? It doesnt make any sense for me. Am I missing anything here?

I was informed by my lawyer, that this was the information provided bye another representative lawyer in Vermont.

I have also seen other people's postings regarding the 140 approval. So, I myself do not think the information makes sense. I think they are swamped with applications and are way behind the schedule. It appears that they are taking about 9-11 months for 140 and I-485 is over 12-20 months. Some lucky chaps do beat this schedule and get earlier approvals. My case is EB2.

I was wondering if anybody is in the same boat as me. My lawyer called INS and everytime he calls they tell him to contact after 30 days. I can't understand why INS can't come up with a reasonable date. Every time they say that they are backlogged and they would have some result within 30 days. But now it has been 10 months and I have not received any response for my I-140 application. With this pace it will take forever to get the EAD and the green card.

Can anybody make any suggestions if there is any way to find the precise information on how much time it will take for an application to get processed.

aptu and abhaya_abhaya congratulations !! I guess I'm left alone in this boat of March 2002.
