New passport applied after taking visa stamping appointment

I have a bit unique case which I could not find any answer online. Would really appreciate if experts on this forum could answer this.

My existing passport is going to expire in May 2008. I took my visa stamping appointment for Sep 2007 to get a stamp based on my I-797 which is valid till 2010. I was thinking I am all set as my passport will have more than 6 months left at time of stamping and while coming back to US however my lawyer told me that consulate may not stamp a visa till 2010 if passport is going to expire much sooner(or I-94 may not be issued correctly).

So I applied for a new passport which I am going to get tomorrow, however I can not change my appointment details and fields in DS156(which is based on existing passport), only way is to cancel and pay the fees again(I have already canceled twice on the same number).

If I use the existing appointment and take both passports while visa stamping, will there be any issue or I must need to take a new appointment.
 
You should have no problems. You could have used the old passport if there were more than 6 months of vailidity left on it (after your visa appointment date), or you can use your new passport. When filling out the forms, use your new passport number. When you show up at the Consulate show your appointment confirmation letter and mention the new passport where asked.

I am surprised you were issued a new passport while more than 6 months were still valid on your current passport. For my Pakistani passport I was allowed to apply for a renewal only within the last 6 months of my current passport's expiration. Obviously rules will vary from country to country. I too had booked an appointment using my old passport but showed up at the Consulate with a new passport. I had to book early with the old passport so I could get a favorable date.
