Hi Folks,
I have been following this forum for a while, and have derived a lot of information and support.
Got some good news from my employer today, my LC has been approved.
Here are the details:
PD: Sept 27th, 2002
ETA number: P-05136-*****
45 day letter recd: December 27th, 2005
Replied: Jan 11th, 2006
Approved: Sometime this month..
NJ RIR, EB2

Hang in there all! There is light at the end of the tunnel.
 
Colleague of mine got labor approved.

Does it mean that they finished the data entry but without sending the 45 Day letter??? :confused:

Can you provide the first 5-6 digits of your case number as well as an ipdate when you receive the 45DL :) If you can, post in the BEC tracker thread .... it makes my life a lot easier :D

An open letter to President update news

Dear Immigrants:

I have sent An Open Letter to President (Please review the final version in below) to President, congress and media this week. Unfortunately, many emails were failed to deliver. Both of President@whitehouse.gov and comments@whitehouse.gov failed. I tried several times but failed. Does anyone know any other email address which the whitehouse can get this letter or send to any whitehouse staff who can hand over this letter to President soon? I have got some replies from senators, but some of them say that they just reply their constituents and need contact information in their state, some of them asked to send their email via web form in their website which also require contact informtion in their state. Please deliver this letter to your state senators? I enclosing some emails from senators after letter.

Does anyone know email address of department of labor Sectory ----- Ms. Chao and Director of USCIS ----- Mr. Emilio T. Gonzales? We need send this letter to them.

Dear Immigrants, illegal immigrants union to fight for their status and some people have agreed to give them US citizenship. They may get more benefits than we have! An Open Letter to President George W. Bush

Dear Mr. President:

We write to endorse your admirable commitment to immigration issues. Recently, more and more illegal immigrant issues are in the newspaper and on television. How about the equally pressing problem with legal immigration system? Is America a real welcoming country to legal immigrants? We, as skilled legal immigrants, have been facing the tremendous delays and problems in our green card process.


1. Backlog labor certificates
Some of us have been waiting for labor certificates several years and still are waiting without knowing anything, when and whether we can get approval or not. We cannot change our job when another position is more fitting to us and the employer cannot find this kind of skilled person during our endless waiting. We are not being utilized to our full potential in the intellectual labor marketplace.

2. 45-day letter:
After a backlog case is entered into the immigration system, a 45-day letter should be sent to the employers / immigration attorney, who then must reply to this letter within 45 days, otherwise the case will be closed. But the backlog centers send 45-day letters at random. We are unable to trace our case status and don’t know the process time schedule. In case the 45-day letter mail is missing, missed delivery or the employer has replied to the letter, but the backlog center hasn’t received it, all of those things happen, and result in our cases being closed. We may still wait until we receive a case closed notice. Some cases are closed in error. Some people who submitted their application in 2002 haven’t got a 45 day letter yet.

3. “First in, first out” rule:
There is supposed to be a ‘first in, first out’ rule in the processing of labor certificate applications. As a matter of fact, many labor certificate approvals come out of order. Some people have been waiting more than four years and are still waiting, some people who submitted their applications in 2004 have received their labor certificate approval!

4. Immigration retrogresses:
Even if we get labor certificate approval finally, we need to file immigration petition form I-140 which may take several months to years. After I-140 approval, because of retrogress ( Adjust status I-485 cut off date in May 2006 is Mar. 1, 2001 for India; Apr. 1, 2001 for Mexico; and the others are May 1, 2001 for EB3. We remember it was Jan. 1, 2002 when EB3 started to file based on priority date in Jan. 2005. It's more than 5 years behind now! ), we may still have to wait several years before we can file form I-485 and apply for advance parole which allows us to travel. Our work visa has to be extended again and again while waiting. Our spouse with an H4 visa can’t go to work. We can’t make long term plans for ourselves and our family’s future. We have learned from the Internet that there are 141365 unused EB3 quotas during 2001-2004 due to the serious delays in the green card process. Some people are planning to go back to their motherland country or other countries where skilled people are welcomed. Some of our friends who are in foreign countries have no intention of moving to USA after they hear our stories. The USA may lose some highly educated and skilled people.

5. Security check delay
Extremely long delay (up to several years) of security checks for some applicants during status adjustment.

All of the above are based on facts and our experiences. We earnestly request you, Mr. President, to pay high attention to legal immigrant issues. We have below petitions:

1. “First in, first out” rule, every stage of green card process must follow this rule. Since there are too many backlog cases which may be misplaced, destroyed, closed in error or forgotten; it’s hard for the backlog center to get every single case done orderly, so the priority date should go through all processes no matter when the approval of Labor Certificate or I-140 is issued.

2. The Department of Labor should make public the process time schedule at least once a month. Applicants should be able to track their case status from the internet.

3. To speed up the green card process.

4. Someone who has been staying in the USA legally for more than five years or working in the USA more than three years should be free to get a travel visa to travel, especially to their motherland, no matter in what stage of his/her green card process the applicant is at that time.

5. Someone who has been working in the USA more than five years, his/her spouse should be allowed to get work permission.

6. Someone who has been filed application for green card more than 3 years should be allowed a 3-6month legal stay in USA after he/she is out of status (lay off and company close or green card application is denied). We need enough time to sell our personal property and set up a new life for our family.

Mr. President, we know you are worried about homeland security and illegal immigrant issues. We have below suggestions for your reference.

1. Illegal immigrants in the United States:
Set up fast and simple channels for the qualified illegal immigrants to get temporary work visas but shouldn’t let them become US citizens unless they re-enter the USA with legal documents and then go through the same path to citizenship as legal immigrants. They will bring positive information to the people who want to come to USA that the United State is a nation of laws and there is no hope to become a US citizen if anyone enters this country illegally, which will help to prevent illegal immigrants coming.

2. New illegal immigrants
Leave digital fingerprint and deport them immediately, but must give them all detail rules about illegal immigrant and US new immigration law before deporting them. If they are caught again, they will be denied entry to the USA forever.

3. Legal and illegal channel

Open the legal channel widely for the people who are qualified to come and live in USA and make illegal immigrant very difficult to come and live here. This is the key to prevent illegal immigrants.

We have more detail thoughts for above suggestions. If you are interested in more details, we will write you another letter.

Dear President, all of us are skilled people and paying taxes. We would like to contribute our intelligence and skills to this country’s economy and work to advance technological development, but we have endless worry and pain waiting for a green card! We are suffering!

For most of us who go through the labor certificate process, it seems that we may have to spend a decade to go through the entire employment-based green card process, if we are lucky enough to get it. If we fail to get approval in any stage, we may have to leave this country soon. It is a very long green card journey. The journey is in darkness. Many of us haven’t visited our family members and friends in our motherland country for many years because of green card problems. Also, it is hard for our family members to get US visas to visit us. We are very homesick; we miss our family members and friends so much. We can’t stand being apart from our family especially when our parents are very sick, but we are unable to take care of them. Some people even missed seeing their parents one last time before they passed away. Dear Mr. President, you have a family, therefore you can imagine how difficult it is for us. We have lost our freedom in some way!

Mr. President, we are looking forward to your solving both legal and illegal immigrant problems successfully during your stay in office.

Guys!! I finally got it after 3.5yrs of wait. exact details not known
45 day letter Dec 05. i hadnt expected it to come so fast after thing started moving. Thanks to GOD!!

what a relief! Thanks to all and saknia for raising our hopes. Seriously i think PBEC is getting its act together to a large extent. For those with older dates its really tough as i feared being one of them when Nov cases started going through.

Do you guys see a noticible change in Screen shot. it will mean your case is picked up.

Saknia - which is the I-140 forum to go to for NY region?

I cant hope for a better memorial weekend

Thanks!!! Hopefully, all of us who are stuck with PDs in 2002 will get cleared soon and move to the next stages.

PBEC update

Guys,

We have tried all possible ways to beat PBEC to improve their processing efficiency. A lawsuit was filed against them and was dismissed in their favor. Letter writing campaigns also did not jolt them as well. Even calling Assistant Secretary DeRocco could not help either.

As a staff (Mark Gorbman) from Division of Foreign Labor Certification (DC office) pointed out, his department could not tell PBEC how things should be run and even if they wanted to they have no power to do so. It seems like Steven Stefanko has full power on how to run the PBEC and unfortunately, he is not approachable.

Even the second man of Division of Foreign Labor Certification (George Sherphard) has warned me that letter campaigns would hamper the adjudication process as there would be too many inquiries on individual files and it would only slow the process.

As for my case, I have approached my state senators and Senator Specter for help. Thinking that I would have leverage from congressional inquiries instead, PBEC is punishing me for making too many complaints/inquiries on them. Look at what they are doing to my file. First they claimed to have sent the NOF in January and we did not received it. When we actually received it and rebutted it, we still have not gotten any news until today.

Bottom line is that nothing works and God knows what is happening behind the scene. PBEC seems to have very powerful backing from someone very influential. They are untouchable. It is very scary and stressful. GOOD luck guys and will keep you posted if I hear anything.

This means your file has not been completely processed. Basically, it is waiting for a analyst to process it further. Hope this helps.

My last words at this forum

I have NOT got my RIR approval which is still stuck in backlog center. However, I want to say good bye and good luck to all you guys in Jersey.

I think I was among those people in NJ who received 45 days letter very early. I got my 45 days letter around middle June, 2005 (almost one year back). I replied and had been waiting for 10 months but no answer. Even until now I have not heard anything.

Therefore, I decided to go with PERM. My company filed my case in late April and I GOT MY APPROVAL in 6 DAYS!!! 27 days later, my I-140 got approved as well. Now I am waiting for the notice from my hometown's US embassdor to do the CP.

Spending a lot of money on attorney fee was the worst thing for my decision doing PERM. It's really not fair that I had to spend extra money to acheve my goal. But, what can I say? Still, I feel sad about the whole thing. Bye.

aycy, mine is different. in the screenshot, the only blank row is the prevailing wage. Does it mean anything? My case has been processed or is being processed? thanks!

I received screen shot a month back with all the fields filled in including prevaining wages.In the email it also mentioned that the case is waiting for further review by an analyst,does it mean that there is any progress on the case.

45 days letter received

I was a silent reader in this thread, but I was reported from my attorney that he received a 45 day letter for my pending labor in PBEC and already sent back a reply. My priority date is 8/16/2004, so it seems like PBEC may be finishing the data entry work, as they commited it finishes by the end of June. My case is RIR EB3 NJ and the case number is P-05157-xxxxx.

I hope the PBEC complete the data entry as they commited and increase approvals.

I think I was among those people in NJ who received 45 days letter very early. I got my 45 days letter around middle June, 2005 (almost one year back). I replied and had been waiting for 10 months but no answer. Even until now I have not heard anything.

Therefore, I decided to go with PERM. My company filed my case in late April and I GOT MY APPROVAL in 6 DAYS!!! 27 days later, my I-140 got approved as well. Now I am waiting for the notice from my hometown's US embassdor to do the CP.

Spending a lot of money on attorney fee was the worst thing for my decision doing PERM. It's really not fair that I had to spend extra money to acheve my goal. But, what can I say? Still, I feel sad about the whole thing. Bye.

Now thats a very interesting exception. I am quite sure, and many in this forum can vouch for, that PBEC has not completed entering data for many of the 2003 cases, let alone going into 2004. There are quite a few from 2003 who are still waiting to receive the letters. Yours might have been in the right place in the right time.

Hopefully everyone who has been awaiting, catch up soon as well.
