New I-797, previous stamping expires, can i get stamping in cananda,mexico or India

Hi,

I changed my employment from contracting to permanent. My h1B is approved and extended and i have received the i-797 also. I will be traveling to India for a short visit. Checked with my lawyer and they suggested that i get my stamping. My visa is expiring sept 2010. So should i get my stamping or can i come in to the country with my old visa?

If i want to get stamping can i got o canada or mexico for stamping instead of India considering the rejection rates in india for this year.

Appreciate your inputs.

----- H1 job is not a permanent job it is till H1 validity.

-------------------- I dont know why your Lawyer says you must get Visa stamp. If your H1 approval has I-94 attached with the approval notice (lower Ridht side) you dont need to get new Visa stamp and can enter US with valid Visa stamp BEFORE sept 2010. if you have valid H1 Visa stamp then you CAN enter US and at POE you must show Valid Visa stamp in Passport AND Latest H1 Extension or H1 transfer approval notice to Officer at POE and you will get I-94 till your Latest H1 approval notice.

----------------You can go to canada or mexico for Visa stamoing but if Visa is rejected you have to go to India Directly from canada or mexico .Appreciate your inputs.

I have a similar case.
I am travelling back on September 10th, and both my Visa and I-94 are valid till September 24th.

My H1-B extension is in process and I did not receive the approval yet.
I may receive it when I am in India. (leaving next week).

Do I have to attend visa? Or will they allow me without any problem in Port of Entry in USA?

Please let me know.

If they may not allow me 'coz Visa/797 are valid only for only 10-12 days, what would be my options?
Would I be sent back to India? Or can I try attending in Mexico or so?

Any inputs are appreciated. Very nervous...
