New here, a lot of questions !

Hello everyone and happy new year !
I am very glad to have found this forum as I'm really afraid to send any form with a mistake...

I am Belgian, married to an US citizen and living in Florida with him. I came here with a Visa waiver in September (ended in December) but as our life has changed a lot lately (I'm pregnant) I haven't been able to send my application yet. I have some questions about other forms too, I hope it is ok... (if it isn't, feel free to send me to the right part of the forum :o )

- First of all. If I need to travel after having sent all the documents but before having my Green Card, do I have to do something special to be sure I'll be able to come back ? I had heard I couldn't leave the US for three months after sending the applications, is that right ?

- It's a silly concern but... I have two middle names and there is not enough space to write those on the forms. Can I just "forget" one of them (but they are in my identity papers) or put an initial ?

- When filling the G-325A Biographic Information : I know I have to send it twice, one for me, one for my husband but am I the applicant every time or do I have to give my husband's informatio (last addresses, employment etc) on his documents ?

- When filling the I-130 : on point 21. I have to give the last address where we lived together. is that the last address where we lived abroad or is our current address in Florida good ?

- Here are my I-485 questions !
In part 1 :
Current USCIS status. I came with a Visa waiver, I am a visitor, right ? Is that my USCIS status ?
In part 2 :
I am applying for an adjustment to permanent resident status because : Other basis of eligibility ? Is "I am married to a US citizen" enough?
In part 3 : They ask for my nonimmigrant Visa number, the date and the consulate the visa was issued... is my I-94 number enough ? But it wasn't issued by any consulate...

- And one last thing... Do I have to apply for a I-765 : application for employment authorization or is the I-485 enough ?

That's all... I'm sure my questions seem silly but having so much documetns to prepare is quite scary, you all know that ! I'll keep looking on the forum to see if the answers to my questions are somewhere but if any of you could help... Thank you !! :)
 
If you want to work then you will have to apply for and EAD (I-765) I got mine approx 2 months after filing. Once you have it in hand, then you can legally accept a job offer and begin working. If you dont file for this, then you can only work once you have your greencard in hand

As for travelling, I would be careful. Right now, between the date your visa waiver ran out and the date you file your AOS you are out of status and accruing a ban from the US....once this hits 180 days you are subject to a 3 year ban, so to leave the US you would be denied entry upon your return and not be allowed to re-enter until the ban is up...the AP travel permit will not protect you from this. However, if you file your AOS before the 180 days is reached then you should be fine....Im sure someone will correct me if Im wrong as my knowledge in this area is a bit hazy. Oh- and if you do want to travel then make sure you apply for the AP document along with your AOS and EAD ;) ...mine took the same length as my EAD to receive.

As for the non immigrant visa number.... as you didnt enter on a non immigrant visa then you dont have one, therefore the answer will be 'none' or N/A (the number on your WV is just your arrival/departure record number). Make sure you make a copy of the front and back of your I-94W and include it in your application as this proves that you legally entered the US with inspection.

I wouldnt forget your middle names if I were you. If you cant fit them all into the spaces provided, then attach an additional sheet and include them on there. Also number the sheets and make it clear exactly what sheet the additional information is on (the USCIS officials literally tear into the application packets and shuffle the papers around, so by numbering the sheets it makes their lives a lot easier and helps stop your additional information getting 'lost').

As for the G-325A, make sure that you both fill out all four pages each...so 4 pages have your info on, and the other 4 have all your US husbands info on...so yes, your husband will need to fill out his previous employment/residence details.

For the last previous address which you lived together...I would assume that would be the place you are living now.

For the eligibility to file....yes, marriage to a US citizen if fine :)

Congrats on marriage and pregnancy. Can I assume you got married between September and December?

You should not leave the country after your marriage, until you get your Advanced Parole (via form i-131, which can be filed with i-485 at no extra charge)

As suggested before: fill out what you can in the original form, but include an attachment with your full names. I had the same "problem" and have never had an issue. With my naturalization I got rid of my middle names alltogether.

Yes, one form for each, his with HIS information. Use the electronic form on their site which gives you the 4 printed copies for each automatically on filling out all info only once.

No, your "out of status". Fortunately not long enough to get any penalty, but make haste!

Yes

No, you don't have a visa, so "N/A"
And one last thing... Do I have to apply for a I-765 : application for employment authorization or is the I-485 enough?
It's not necessary, unless you have to work, but again: when you file this together with i-485 there is no extra cost (other than extra passport photos), and it will give you access to getting an SSN early on. My advice: do it... for the "you never know" situations.

None of your questions are silly. I've been through visa, GC and naturalization processes and know that they can be very daunting. Now that I'm taking my new wife through GC process everything seems much easier...
