Hi All,
I am currently on a H1b with an employer .Can I apply for a new H1 with another employer?If I can apply, do I have to leave the country before I can join the new employer according to new rules.Also,Do I require paystubs to apply for this new H1?
Please let me know.

You are confused

Why do you need a new H1B?. You already have H1B just transfer to new company. You no need to go out of USA at all to switch to other company.

What if the old company has not paid anything in check but paid only cash and deposited 2 months tax for 4 motnhs working. and now had been out of job for more than 3 months. please reply as i need help URGENTLY TO DECIDE WHETHER TO CONTINUE STAY IN US OR LEAVE FOR HOME COUNTRY AND WAIT FOR TRANSFER TO OTHER COMPANY

Try to apply transfer of H1. If INS ask for pay stub ask you attorney to explaining the old company situations. Some time they accept it and black list the old company.
 
H1Transfer-No Paystub

This is only a suggestion:...(based on some old postings in this forum)...

If an RFE is generated during H1b transfer, requesting for paystatement from the previous employer..

In addition to highlighting inability to give paystatement(due to employer's problem)...It may work out if you can get a letter from the previous employer(experience/employment letter,the letter format iam not aware of ) or may be u can ask ur attorney.

Assuming that the RFE is only for paystatement,then if u don't respond within 90 days,INS generally partly approves your transfer but may not extend your Authorised stay.

Thanks for reply but where ever i have gone all attorney ask for paystubs to proceed SO IS IT NECESSARY TO SUBMIT PAYSTUB ALONGWITH THE TRANSFER APPLICATION OR HAS TO BE SUBMITTED ONLY WHEN ASKED.

And also one question still unanswered is WHETHER WE HAVE TO GO BACK TO HOME COUNTRY AND GET THE STAMPING BE DONE FOR NEW COMPANY OR WAIT HERE TO GET THE VISA BE TRANSFERRED AND THEN GO TO HOME COUNTRY FOR STAMPING.

Getting paid after H1 got rejected

Hi Ginnu / UN / other Gurus,

My friend have a strange problem.
He is working as a System Analyst for a Los Angeles based company on H1 for the past 3 yrs. Now, his employer filed for the extension of H1 on july 04. USCIS denied it and send a report on sep 01 and obviously his employer filed an appeal for the denial decision.
The appeal is still pending and his present H1 got expired 2 weeks ago. But after that also, his employer paid him for one pay period and he hope that he is going to get paid for the coming pay periods too.
But my friend checked with some attorneys abd they said that when a H1 appeal is pending and if the visa got expored, you will be out of status.

So, because of he is getting paid, who is in trouble, the employer or the employee.

Sorry, for posting in the unrelated thread. I am in a urgency and couldn't able to find a related thread.
