Hi guys!
Wanted to know the exact details of the new H1B law wherein they are saying that all have to go to their home country to get the visa stamped.

1. Is this for an H1B transfer or only for new H1B's

2. Is this for someone who wants to renew his H1B with the same company?

3. How will this work, do they have to go right away or go whenever they want to and then get it stamped?

4. Will they give the I94 card with the H1B approval or no?

Guys pls help with these queries as I am sure that they will be very imp for quite a few of us
 
This is for H1 renewals and wish to travel outside of US. A person would need to go out of country to get new visa stamp if there is a change of status (F1 to H1 or H4 to H1). A visa is required only if the person is travelling out of US while maintaining current status (H1 renewals). Usually H1 extension has I-94 extension attached to it as proof of authorized stay. If a person is not maintaining status, H1 extension will not come with I-94 and it is must to travel out of USA to get visa stamped and enter into USA to get I-94. A visa is not required for changing employers on H1 and remain in US.

Thanks for the information. I just have one quick question.

* I got my H1B stamped (company A) on my passport, which is valid until 2006. Now, I changed companies and I am planning to go to Canada. Do I have to get my new company visa stamped on my passport before I go to Canada ? or is it valid to go out of the country and come back with the same old company H1B stamped on passport ?

No need

No need to get visa stamping for new company. As long as the existing visa is valid u can use that one to travel. visit Consulate website for details.
 
Only thing on top of this is to be ready with the supporting evidence , like your new approval, last few paystubs , etc. In case they ask while entering the country.
 
yes there is no probs with old comp visa you can use it specially between canada /us

!00% no probs enjoy the trip

Can you tell which is the counslate web site from where we can get exact details on H1B visa.

Also which is the site whcih can give detail on H1B out of status or instatus.
and is it necessary to receive the pay or salary for instatus.
