New H1B for 1st visa stamping....I need tips/pointers. Pls help!

Hi everyone,

I got my HIB approval on the 17th of Aug under premium processing (EAC number is dated Aug 8). I am now going to the Consulate for visa stamping soon. I have fears of being interviewed by the Consuls for I was denied 3x of J-1 visa last year. I would appreciate it so much if you will give me pointers for my interview.

What do Consuls usually ask? What documents do they usually look for? How high is the percentage of being denied or approved? I would also be very thankful if you share your experiences at the Consulate section.

My biggest question to you:
Why was your J1 visa was denied ??

It depends on that.
 
Max, I was refused a J1 visa because the consuls were not convinced I have strong reasons to come back to my home country after the cultural exchange program. It is about my family status, I guess. The last consul suggested that I upgrade my visa application from J1 to H1 so I needed to look for an employer who could sponsor me on H1. I hope this would help. Thanks!

You should have absolutely NO problem with H1 visa in this case.

H (and L visas) allow for complete dual intent (that is even though these visas are non-immigrant, you can still have a immigrant intent) -- this is different from other visas where your visa gets denied for having a immigrant intent. (or in other words, when you cannot show "strong ties back to home")

A consulate CANNOT deny a H visa for expressing immigrant intent -- the law is very clear on this.
They won't even ask you questions reg. immigrant intent / ties to home when applying for H.
Even if they ask, you can truthfully say your intent to immigrate (if it is so) -- no issues.

Thank you for telling me that. That made me feel real good. I am relieved! I was told the same too in the past but I just wanted confirmation from others. I also have heard of few having problems with H1B visa stamping though. I wish everything will turn out fine for me.
