My first 3 years term of h1 and I94 expired in February. I am currently maintaining my status, by virtue of H1 extension petition being pending. If I switch job through a new h1 and my h1 extension petition is withdrawn, will my stay between Feb. and July be illegal, as I never really received an H1 extension.
-- I hope your stay Feb and July will not be counted as illegal or out of status as you filed H1 extension before expiry of I-94
--If you switch through NEW H1 then you will not get I-94 attached with that New H1 approval and may have to go out of US get new H1b stamp and re-enter with new H1 visa
-- if you want to switch, you can get H1 transfer once you get the approval of H1 extension , that will be the best option because with H1 transfer you will get new extended I-94, wait for the extension to be approved then, file H1 transfer through new employer
