Hi,
My employer filed my new H1 case through premium processing in mid september. I have the following questions:

1) How long it will take to get my H1 approval from INS. I heard it takes 15 to 20 days, so should I expect to recieve it in mid October?

2) I am a landed immigrant, currently living in Canada. I am getting married in January 2005 so I have to go to India. I want to know if I get my H1 before leaving to India, can I apply for H4 visa for my wife in India and how long it will take to get approved. It would be good if it takes 5 to 10 days for H4 approval so that I can bring her to US. Or What would be other options?

3) Is it possible to apply for both Canada visit visa and H4 visa, as in some case we may have to go to Canada. I alone have no problem going to Canada as I have a PR card. Just my wife need some visit visa to go to Canada.

Thanks

1. unless they issue an RFe you should get in in 15-25 days.

2. Yes u can apply for H1 stamp and H4 at the same time at the Us consulate, u dont have to apply to the USCIS for H4, no preapproval for H4 is required.

3. the process involves making an appointment at the consulate having jurisdiction over ur Indian address. There a is a long wait time for appointments so it might be better to make one early on. There are different requirements for different consulates so be sure to check them out, some require sending supporting documents 30 days in advance, most do not. Also you will neet to have marriage certificate and will need to get spouses names endorsed on each other's passports. So leave plenty of time after wedding to get those things done. Other reequirements include photos of the ceremony, invite etc.
In case u r getting ur stamp before u go to india then ur wife can go alone for H4 but the recomendation is to get the stamps together. But that might not work in ur case as u will probably start work before ur marriage.

4. taking the canada visa does not matter on H4, since they are visas from different countries they have ne realtionship with each other, u can have as many visas as u like.

Thanks so much for you reply, waitin_toolong!

I have one more quick question. Is there any way one can suspend H1 premium processing and get money back, due to some un-avoidable conditions. Will it effect anything?

Thanks

Once pay the fee, under any circumstances, BCIS will not refund the money for any service(s). That is BCIS.
