Hello all,

I am working on H-1 visa and I am currently in Germany on a business trip for 3 months. I want to change my company and the new employer said i need I-94 to apply for H-1 transfer? For that I need to go back to US.

Does any one what are the rules to in getting a new H-1 than H-1 transfer? If I apply for new H-1 and after getting it, can I go back to US on old H-1 and then quit the old job and change companies?

Any information is greatly appreciated. Thanks in advance.

A h1 transfer facilitates the usage of old company's I94 to enter US and continue on to the new company with the same I94.
For A new h1, you need to get a new stamp and cannot enter using the old company's h1.
If you enter using old company's h1, you need to file a new h1 transfer in order to work with new company. U can still do this way, since you can start working for new company as soon as INS receives the h1 transfer petition.
