They may keep the check.

If you do, they will simply return it to you unprocessed.

This is the best case scenario. They may decide to keep the check because they have a disclaimer in the M-476 guide and I quote:

"Remember that your application fee is NOT refundable even if you withdraw your application OR IF YOUR CASE IN DENIED" (my caps)

Takshila is wrong about them keeping the check in this case. They never accept the appl if it is sent before eligibility, they return the complete package.
When they say they will keep the fee that is applicable to cases where the applicant abandons the case or the agency denies citizenship.

That's good to know. Has this happened on this forum where the application package and check was returned ?

Yes , it has been reported. All the applicant gains from applying too early is a loss of a few days during this mailing back and forth!!

72 hours

There was a case when we were filing green card
where an individual sent documents 72 hours before eligibility and Immigration did not discover it until the approval process and the case was denied and the person had to file the case all over again and lost money and also 9-11 months in the process.

He/she tried to go through the attorney I guess and claimed that it was the fault of INS for not rejecting the case at the time of filing but denying the case at the time of approval (9-11 months later)

Many such cases where the person had filed a few days before eligibility had been approved however this particular person once he/she was denied had no other choice but to file again.

I remember this since this was a big issue at that time and the person kept us updated during this process and also during his/her second process.

Please be carefull and better to pay more and file a few days later than cut off date

There was a case here or on another board where the person applied on the exact 90th day and it got returned. Guess they may not even accept the 90th day as 100% valid.

The person had to turn around and re-send it in wondering why it got sent back. So you might want to play it safe and submit it a few days after your 90th day comes. Either way, you won't be able to do that until the new changes are in effect...
