New E-3 Visa

Hi,

Is the new E-3 visa for Australian nationals eligible for green card processing?

From what I've read, E3 visas do not have dual intent like an H1b (i.e. immigration intent), while the E3 is very similair to the H1b. Just like with E1 and E2 there are ways to work around this issue to apply for your greencard. You probably should consult with an attorney to check the possible avenues.

E3 and immigrant intent

Hi,

I've read that even though the E3 isn't dual intent, that a pending green card petition or labour cert application isn't grounds to deny the E3.

Does anyone know how to answer the tricky question from the Consulate regarding immigrant intent if you do have a pending labor cert petition for perm residence? In particular if you've already passed the 6 years on an H1B and got extensions based on pending green card.

Well even the attorneys are divided on this issue..... most of them agree that E3 wud be harder to obtain the GC .. i am stuck in teh same situation adn have no clue wat to do .......

does any one know any workaround .. shud i be pressing my Employer to put me on H1 B so that i can get into the main stream.
