New developments in my I485 (NIW) case: before my Priority Date

Dear All,

I started the same thread in NIW/EB1 category - Please ignore if you have aleady read my post.

My wife and I applied I140/I485 concurrently in NIW category.

I am confused with the recent case update on our I485 applications.

The case update has the following details:

CASE STATUS: Initial Review
UPDATE DETAILS: I-485 case has been transferred to SEATTLE, WA location for processing. USCIS will let us know if they need finger-printing or interview call after background check.

My Confusing is mostly about my priority dates. PD for I485 in EB2 category -India, as per March'2011 visa bulletin, is 08MAY06.

Why did the USCIS review our case a year before my PD that is June07. Is this a common procedure and a significant step? Did anyone else have a similar case update?

Why did USCIS transfer my case to Seattle, WA when we live in Denver, CO?

Totally confused!!


Case Time-line:
Nationality: India
I140 PD - June 2007 – Submitted to TSC
I-485 PD- July 2007 - Submitted to NSC
I-485-First update- August 2007 - transferred to TSC
I485 – LUD – Feb 2011 - transferred to Seattle, WA for processing
I140 - approved - Jan 2008.
EAD- Up for renewal
AP- Up for renewal

Processing may actively go on while your PD is not current. They sometimes even do interviews for retrogressed I-485 applicants.

They can't finalize the approval while retrogressed, but they can still do everything else and mark your case as "preadjudicated", so your GC can be issued ASAP after the PD is current again.
