New Development. Need Help

Folks:
I was in conference call with my Lawyer and the Sr.Paralegal at My company.

Background:
My LC was approved on May 7th 2002 EB3-RIR
My I-140 was approved on July 27th 2002
My P3 was generated on Aug 21st 2002
My P3 was received by my lawyer on Aug 27th 2002

Situation and Issues:
I was told by my lawyer that he would mail my completed DS 230 Part I along with the new fees of $335 on Sep 4th.
Today I get a call from him and my Sr. Paralegal that my case would be rejected if I dont send the PCC, BC, MC, etc along with my DS 230 Part I.
I told them that I have made inquiries with other folks in similar situation and that only DS 230 Part I is needed along with the relevant fees.
I was flatly told that this was not the case and if I want to pursue my case without the documents ( PCC, BC, MC ect) then I should do it independently.
They are going to mail me my P3, my completed forms and the Money order for the P3 fees. I should be getting them tomorrow.

Help and Assistance from Forum:
I guess I am on my own now. I will be pinging my fellow CPers for more info. In a way this is a good developement. I am out of the clutches of the lame duck, moronic bottom feeders of the legal society.

Current Assistance:
Can someone confirm what I have to mail to the office in St. Louis. Guilty of repeating myself. The below given is the list I have to send to NVC. Can someone confirm or deny.

* DS 230 Part I ( for my wife and me)
* DS 2001 - ( for my wife and me)- Is this required. Is it still required
* Mailed in a barcode envelope
* Fees Sticker or something that has my fees information and the bar code.
* Fees- $670 ( for my wife and myself)- Confirmed with NVC the new fees is $335

BTW, I have already confirmed with NVC that I need to send my DS 230 Part I ( for my wife and me) and the fees to St. Louis PO Box.

I would truly appreciate all the help and assistance. Thank you for posting.

PS: Immigration Lawyers are the scum of the earth. Just a sentiment!
 
suggestions

you can call NVC and check. even if you dont give a case number (ie enter all zeros) you will get to an operator sometime. ask them, they are usually reasonably friendly.

waiting for PCC can delay P3 app by 45 days atleast.
technically you dont need a lawyer from the P3 stage onwards. You and your company can do all the work (90% you)

you can also check with another lawyer.

I would suggest that you carefully go thru the letter (pkt3) that NVC sent to the lawyers. In the past there were some instances when NVC wanted more documents along with just the DS230 part1, fee, bar coded envelop, etc.....

So, your lawyers might be right when they say that you need to send PCC, BC, MC etc....
You should send Marriage Certificate if you got married after you applied for I-140.

For me personally, We did not have to send any supporting documents.

Anyway, this might be a good thing for you since you are the driver of the procedure, rather than your lawyer.

Have already confirmend with NVC. For my case they just need DS 230 Part I and the fees. I want to confirm with other forum members regarding the bar code, what items are bar coded in the P3. What else to send etc.

My Packet 3 stated clearly in English that at this moment " Only DS 230 Part I and Fees" I have sent my DS 230 Part I along with the respective fees for me and my spouse. We both were included on the barcoded Fee Letter.

Thanks to everyone's advise and help from forum, I will be get through this stage.

u r right. I think u need to send ds230p1, ds2001, fees, barcoded ltr.
That's what my layer did.
Even in P3 docs they mentioned that did not send any docs rightnow but make sure you have that to show in cp interview (so checkmark X all the relevant to you in ds2001).
u can file all docs yr self.
in this post few people has been asked for additional docs (mainly MC) when p3 reached back to NVC but that is because their barcoded ltr does not show any dependant name. I believe yrs showing all the dependants and fees for each person.

Some comments:
1. NVC has different sets of instructions depending on the type of consulate - alpha, alpha plus etc etc. For some consulates, NVC not only collects PCC, but also schedules interviews etcv.
It is very likely that a wrong set of instructions have gone out in your case and hence the reason for your lawyers behaviour.
2. Most lawyer are new to the CP process. I remember my lawyer had asked me to send PCC etc, without reading clearly that they need not be sent.

I think doing CP by yourself is very convenient!

If your consulate is in India your list is right. Once you get P3 just check for any updated requirement.

P3 onwards procedure is pretty simple & nice to do of your own. In fact attcah a letter withg P3 for NVC directing to send all communications to you.

At last your lawyer will realize how wrong how was.


Well there are few good lawyers around with CP experience but many do not have any clue.

Bottoma line send the documents that are list in P3. Though Ihad my lawyer but I did of my own. At least he is co-operative in that. If you need any help you may mail me.

Hello satish dave (and all fellow CP-ers),

Here is where I'm:

1. Applied for I140 (with AOS and not CP) (was SINGLE then)
2. Got I140 Approved (in Sep 2001) (still was SINGLE)
3. Decided to do CP (@ chennai) applied I824 NSC jan 2002 (still was SINGLE)
4. Got engaged in August 2002. Planning religous mariage in Mar 2003.
5. I824 Pending still as of today (expecting to be approved in next few months).


( I'm just thinking of going to India in Nov 2002 to get a civil marriage done and get my Marriage Certificate)

Questions:

1. Now, if I need to included my wife to be along with my CP in india what should I do?
2. Would Civil Marriage Certificate enough for NVC to add my spouse when the PACKET 3 Arrives?
3. Should my spouse be in US to add her to Packet 3?
4. Could I add my spouse to Packet 3 without Marriage Certificate?

Are there any other options (like Wife-to-Follow-to-Join)? If so could you please elobrate on them?

because for Indian consulates u do not need to send PCC, MC, BC etc ...

If ur lawyer is being a pain then do it urself .....its not very difficult and of course lawyer's aren't much help in the last stage of CP ...

Questions:

U can do 2 things:

One is what u have stated here ...do a civil marraige, get the MC and then send the P3 ...

The other option is ... after u have sent ur P3 to NVC and then to the consulate, u can directly approach the consulate to add ur wife to ur case. This has to be done before u re-enter the US after the succesfull interview....

The consulate will generate a P3 for ur wife and then assign a interview date after receiving the completed P3 ... she will receive a separate P4 .. this can take upto 3 months after she sends the P3 back to the consulate ..

2. Would Civil Marriage Certificate enough for NVC to add my spouse when the PACKET 3 Arrives?

Yes

3. Should my spouse be in US to add her to Packet 3?

No

4. Could I add my spouse to Packet 3 without Marriage Certificate?

I don't see any problem with your packet 3 encloses, any way as other members mentioned, it won't hurt by confirming this with NVC.
As of December 2001, "Packet 3" has been renamed "Instruction Package for Immigrant Visa Applicants." But we will still call it Packet 3 as it is easier to refer to compared to long name.
OF-169 was replaced by DS-2001, it was mentioned in that
encloses:
1. DS-230, Part 1 Application for Immigrant Visa and Alien Registration - Biographic Data.
2. DS-2000, Evidence which may be presented to Meet the public Charge Provision of the Law.
All other documents are required at the time of your visa interview that it was mentioned in the document.
Regarding obtaining PCC: After applying for PCC at Local Indian Consulate (ours is Chicago) they will try enquire at our local Indian police station, if they don't get a reply from India with in 35 days. on 35th day, Indian Consulate office (Chicago, Washington DC etc.) will grant the certificate. If you want that immediately, call Indian embassy, visit their offices and talk to them, they are helpful. Their URLs are
